  TITLE OF BILL: An act to authorize Kimberly A. Cooney of the village of Cambridge to take the competitive civil service examination for the position of police officer and be placed on the eligible list for employment as a full-time police officer   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to permit Kimberly A. Cooney to take the competitive civil service examination for the position of police offi- cer, and contingent upon her score, to be eligible to be placed on the eligible list for appointment as a full-time police officer with the village of Cambridge.   SUMMARY OF PROVISIONS: Section 1 provides that notwithstanding the age requirements in para- graph a of subdivision 1 of section 58 of the civil service law, Kim A. Cooney may take the competitive civil service examination for the posi- tion of police , offer. Section 2 provides that Kim A. Cooney shall otherwise be subject to the merit and fitness provisions of the civil service law applicable to full-time police officers. Section 3 provides the effective date.   JUSTIFICATION: Due to the provisions of the Civil Service Law, the village of Cambridge has requested legislation to peLiuit one of their part-time officers, Kimberly A. Cooney, to ,be eligible to take the civil service examina- tion since she is currently older than 35 years old.Recruiting and retaining well-qualified full-time police officers is challenging for small and rural police departments. At the request of the acting Chief of Police of the Cambridge-Greenwich Police Department, this bill would address this issue by allowing a part-time police officer of the village of. Cambridge Police Department to be eligible for full-time status with the Cambridge-Greenwich Police Department. While age restrictions certainly have practical value, they do not always reflect the ability of some candidates to perform full-time police duties.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to authorize Kimberly A. Cooney of the village  of  Cambridge  to
          take  the  competitive  civil  service examination for the position of
          police officer and be placed on the eligible list for employment as  a
          full-time police officer

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding the provisions of section 58 of  the  civil
     2  service  law,  including  the  age  requirements  under paragraph (a) of
     3  subdivision 1 of such section, or any other  provision  of  law  to  the
     4  contrary,  Kimberly A. Cooney, who has been continuously employed by the
     5  village of Cambridge, in the county of Washington, as a part-time police
     6  officer, shall be eligible to take the competitive civil  service  exam-
     7  ination  for  the  position of police officer and shall, contingent upon
     8  her score on such examination, be eligible to be placed on the  eligible
     9  list  for  appointment as a full-time police officer with the Cambridge-
    10  Greenwich Police Department.
    11    § 2.  Kimberly A. Cooney shall otherwise be subject to the  merit  and
    12  fitness  provisions  of  the  civil  service law applicable to full-time
    13  police officers.
    14    § 3. This act shall take effect immediately.
