  TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the issuance of specialty plates for Clean Pass vehicles   PURPOSE OR GENERAL IDEA OF BILL: To create and issue special license plates for Clean Pass vehicles.   SUMMARY OF PROVISIONS: Section 1: Amends section 404-ee of the vehicle and traffic law to create distinctive plates for Clean Pass cars. It allows a distinctive plate to be issued showing proof to the commissioner that they are Clean Pass. It states that the plates will be issued like any other license plate except with a one-time ten dollar service charge. Also, this section defines what a Clean Pass car is. Section 2: The plate will be designed and distributed by the department of motor vehicles. The department will receive $6,000 in the form of a surety bond unless the amount of two hundred orders for distinctive plates is fulfilled. If more than two hundred sets are sold, the bond will not be renewed; however, if less than two hundred sell the department of motor vehicles will be entitled to renew the bond. Section 3: Effective date.   JUSTIFICATION: Clean pass vehicles currently accrue benefits such as driving in HOV lanes by being issued stickers after meeting certain requirements. However, these stickers can cause damage to cars as well as the fact that the stickers are easily stolen or transferred to other cars that do not meet the standards of fuel efficiency. This bill proposes that special license plates are issued instead of the stickers during normal registration as long as the DMV decides that the vehicle meets the Clean Pass standards. These plates are unable to be transferred unless that vehicle also passes the requirements of fuel efficiency. Also, these license plates will raise awareness for Clean Pass cars and their bene- fits.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: Six thousand dollars subject to renewal if less than two hundred sets of plates are issued.   EFFECTIVE DATE: This will go into effect on the one-hundred and eightieth day after becoming a law, except section 3 which will go into effect immediately.

        AN ACT to amend the vehicle and traffic law, in relation to the issuance
          of specialty plates for Clean Pass vehicles
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 404-ee to read as follows:
     3    § 404-ee. Distinctive plates for Clean Pass vehicles.  1.  Any  person
     4  residing  in  this  state  shall,  upon request, be issued a distinctive
     5  plate bearing the words "Clean Pass  Vehicle".    Application  for  such
     6  plates  shall  be filed with the commissioner in such form and detail as
     7  the commissioner shall prescribe.
     8    2. The distinctive plate authorized herein shall be issued upon proof,
     9  satisfactory to the commissioner,  that  the  vehicle  is  eligible  for
    10  certification as a clean pass vehicle.
    11    3. A distinctive plate issued pursuant to this section shall be issued
    12  in  the  same  manner as other number plates upon payment of the regular
    13  registration fee prescribed by section four hundred one of this article,
    14  provided, however, that an additional one-time  service  charge  of  ten
    15  dollars shall be charged for such plate.
    16    4. For the purposes of this section, "Clean Pass Vehicle" shall mean a
    17  vehicle  designated as such by the department of environmental conserva-
    18  tion, the department of transportation or the department of motor  vehi-
    19  cles  for the purpose of eligibility to use certain high occupancy vehi-
    20  cle lanes pursuant to the clean pass program.
    21    § 2. 1. A distinctive plate established pursuant to section 404-ee  of
    22  the  vehicle  and  traffic law as added by section one of this act shall
    23  only be designed, produced and issued upon the delivery to  the  depart-
    24  ment  of  motor  vehicles of a surety bond in the amount of six thousand
    25  dollars, which shall be executed by a surety company authorized  by  the
    26  department  of  financial  services  to transact business in this state.
    27  Provided, however, that if the commissioner of motor vehicles shall have
    28  received prior to plate design, production and  issuance  at  least  two

     1  hundred  orders  for such distinctive plate together with the additional
     2  one-time service charge applicable to each such order,  which  shall  be
     3  non-refundable,  no  such  surety  bond  shall  be required. All service
     4  charges  collected  pursuant to this section shall be deposited pursuant
     5  to the provisions of section 404-oo of the vehicle and  traffic  law  to
     6  the  credit of the department of motor vehicles distinctive plate devel-
     7  opment fund established by section 95-g of the  state  finance  law  and
     8  shall  be  used for the design, production, advertising and distribution
     9  of distinctive license plates in accordance with such section 95-g.
    10    2. If, upon the expiration of two years following the date upon  which
    11  distinctive  plates  in  the  series  are  first  available for sale two
    12  hundred or more sets of such plates are sold, a bond delivered  pursuant
    13  to this section shall be discontinued. If fewer than two hundred sets of
    14  such  plates  are  sold  by  such time, the department of motor vehicles
    15  shall be entitled to recover against the bond in an amount proportionate
    16  to such shortfall.
    17    § 3. This act shall take effect on the one hundred eightieth day after
    18  it shall have become a law; provided, however,  that  section  three  of
    19  this act shall take effect immediately. Effective immediately, the addi-
    20  tion,  amendment  and/or  repeal of any rule or regulation necessary for
    21  the implementation of this act on its effective date are  authorized  to
    22  be made and completed on or before such effective date.
