PURPOSE OR GENERAL IDEA OF BILL:
Authorizes Janay Gasparini to take the competitive exam for the position
of full-time police officer and be placed on the eligible list for such
position.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1: Authorizes Janay Gasparini to sit for the civil service exam
and be placed on the eligibility list for full-time police officer.
Section 2: Janay Gasparini is subject to the merit and fitness
provisions of the Civil Service Law applicable to full-time police offi-
cers.
Section 3: This act shall take effect immediately.
JUSTIFICATION:
Under the Civil Service Law, as prescribed under Section 58, no individ-
ual may take the civil service examination, nor be eligible for a civil
service appointment as a police officer, at the age of 43 or older. Due
to this limitation, the Town of New Paltz Police Department has
requested legislation to permit one of their part-time officers, Janay
Gasparini, to be eligible to take the civil service examination since
she is currently older than 43 years old.

AN ACT in relation to authorizing Janay M. Gasparini to take the compet-
itive civil service examination for the position of police officer and
be placed on the eligible list for employment as a full-time police
officer for the town of New Paltz
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding the provisions of section 58 of the civil
2 service law, including the age requirements under paragraph (a) of
3 subdivision 1 of such section, or any other provision of law to the
4 contrary, Janay M. Gasparini, who has been continuously employed by the
5 town of New Paltz, in the county of Ulster, as a part-time police offi-
6 cer, shall be eligible to take the competitive civil service examination
7 for the position of police officer and shall, contingent upon her score
8 on such examination, be eligible to be placed on the eligible list for
9 appointment as a full-time police officer with the town of New Paltz
10 police department.
11 § 2. Janay M. Gasparini shall otherwise be subject to the merit and
12 fitness provisions of the civil service law applicable to full-time
13 police officers.
14 § 3. This act shall take effect immediately.
