An act to amend part D of chapter 58 of the laws of 2011 amending the
education law relating to capital facilities in support of the state
university and community colleges, procurement and the state university
health care facilities, in relation to the effectiveness thereof
PURPOSE OR GENERAL IDEA OF BILL:
To extend SUNY's existing procurement and capital facilities flexibility
provisions through June 30, 2031.
SUMMARY OF PROVISIONS:
Section 1 of the bill amends section 4 of subpart A of part D of chapter
58 of the laws of 2011 to extend provisions relating to capital facili-
ties in support of the state university and community colleges from June
30, 2026, to June 30, 2031.
Section 2 of the bill amends section 4 of subpart B of part D of chapter
58 of the laws of 2011 to extend provisions relating to procurement in
support of the state and city universities from June 30, 2026, to June
30, 2031.
Section 3 of the bill amends section 3 of subpart C of part 0 of chapter
58 of the laws of 2011 to extend provisions relating to state university
health care facilities from June 30, 2026, to June 30, 2031.
Section 4 establishes an effective date.
JUSTIFICATION:
SUNY currently operates under procurement and capital flexibility
provisions that allow the university system to complete projects and
procure goods and services in a more efficient and timely manner. These
provisions support the continued operation, maintenance, and improvement
of SONY campuses, community colleges, and state university health care
facilities throughout New York State.
The current statutory authorization is scheduled to expire on June 30,
2026. Without an extension, SUNY could face delays and additional admin-
istrative burdens related to procurement and capital project delivery.
Extending these provisions through June 30, 2031, will help ensure
continuity in SONY operations and allow campuses to continue addressing
infrastructure, procurement, and health care facility needs efficiently.
SUNY supports the extension of these provisions. This legislation main-
tains existing authority already granted under current law and ensures
SUNY may continue utilizing these procurement and operational flexibili-
ties without interruption.

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 4 of subpart A of part D of chapter 58 of the laws
2 of 2011 amending the education law relating to capital facilities in
3 support of the state university and community colleges, as amended by
4 section 1 of part D of chapter 56 of the laws of 2021, is amended to
5 read as follows:
6 § 4. This act shall take effect immediately and shall expire and be
7 deemed repealed June 30, [2026] 2031.
8 § 2. Section 4 of subpart B of part D of chapter 58 of the laws of
9 2011 amending the education law relating to procurement in support of
10 the state and city universities, as amended by section 2 of part D of
11 chapter 56 of the laws of 2021, is amended to read as follows:
12 § 4. This act shall take effect immediately and shall expire and be
13 deemed repealed June 30, [2026] 2031.
14 § 3. Section 3 of subpart C of part D of chapter 58 of the laws of
15 2011 amending the education law relating to state university health care
16 facilities, as amended by section 3 of part D of chapter 56 of the laws
17 of 2021, is amended to read as follows:
18 § 3. This act shall take effect immediately, and shall expire and be
19 deemed repealed June 30, [2026] 2031.
20 § 4. This act shall take effect immediately.
