MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the environmental conservation law, in relation to reme- dial program requirements   PURPOSE: The purpose of this bill is to ensure that remedial programs include consideration of nearby school or day care facilities.   SUMMARY OF PROVISIONS: This bill would clarify that the provisions of Environmental Conserva- tion Law § 27-1415, which relates to the development of remedial programs for the Brownfield Cleanup Program.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION:   JUSTIFICATION: The Brownfield Cleanup Program recognizes the special status of schools and day care facilities by requiring proposal notification. This legis- lation simply extends that recognition to ensure that when remedial programs are being selected for a site, proximity to schools and day care facilities is considered, in addition to the existing consideration of proximity to commercial, industrial, agricultural and recreational areas.   LEGISLATIVE HISTORY: 2019-2020: A10747(Niou) - referred to environmental conservation   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: This act shall take effect March 1, 2021, and apply to all applications received on or after such date.

          the Committee on Environmental Conservation
 
        AN ACT to amend the environmental conservation law, in relation to reme-
          dial program requirements
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subparagraph  (v)  of  paragraph  (i) of subdivision 3 of
     2  section 27-1415 of the environmental conservation  law,  as  amended  by
     3  section  7  of  part A of chapter 577 of the laws of 2004, is amended to
     4  read as follows:
     5    (v) Proximity to real property currently used for residential use, and
     6  to urban, commercial,  industrial,  agricultural,  school  or  day  care
     7  facilities and recreational areas.
     8    §  2. This act shall take effect March 1, 2022 and apply to all appli-
     9  cations received on or after such date.
