MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the executive law and the public authorities law, in relation to securing grease traps and interceptors at food establish- ments   SUMMARY OF PROVISIONS: Section 1 establishes that the bill is named "Bryce's Law" Section 2 would create a new section 376-b of executive law as it relates to securing grease traps and interceptors at food establish- ments. Section 3 would set an effective date of 90 days after enactment.   JUSTIFICATION: On July 15th, 2019 a horrible tragedy occurred when 3-year old Bryce Raynor fell through an unsecured plastic lid of an underground grease interceptor. Although the young boy was pulled from the trap minutes after he fell in, efforts to resuscitate him were not successful. Even more tragic is that this was not the first child to die under similar circumstances. There are several documented occurrences of children dying after falling into unsecured grease interceptors across the United States, including New Jersey. This bill will help prevent future tragedies by setting guidelines for grease traps and interceptors that are located in a public area, making them safer for the general public.   FISCAL IMPACT ON THE STATE: TBD   LEGISLATIVE HISTORY: 2019-20: A.8525-A (Romeo) - Enacting clause stricken   EFFECTIVE DATE: 90 days after enactment.

        AN ACT to amend the executive law and the  public  authorities  law,  in
          relation  to securing grease traps and interceptors at food establish-
          ments
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  "Bryce's law".
     3    § 2. The executive law is amended by adding a  new  section  376-b  to
     4  read as follows:
     5    §  376-b.  Securing  of  grease traps and interceptors by food service
     6  establishments. 1. For the purposes of this section "food service estab-
     7  lishment" shall have the same meaning as in part fourteen of  title  ten
     8  of the New York code of rules and regulations.
     9    2.  Any  food  service establishment with a grease trap or interceptor
    10  shall ensure that such grease trap or interceptor is designed  to  with-
    11  stand expected loads and prevent unauthorized access.
    12    3.  The  state fire prevention and building code council shall promul-
    13  gate rules and regulations it deems necessary to carry into  effect  the
    14  provisions of this  section, including, but not limited to:
    15    a.  The  form  in  which  a grease trap or interceptor warning sign or
    16  symbol shall be designed;
    17    b. The manner in which a grease trap or interceptor  warning  sign  or
    18  symbol shall be so displayed;
    19    c.  The  location at each food service establishment where such grease
    20  trap or interceptor warning sign or symbol should be posted; and
    21    d. The design of a grease trap or interceptor  to  withstand  expected
    22  loads and prevent unauthorized access.
    23    4.  Local  governments may provide by local law for the enforcement of
    24  the provisions of this section. Local governments may provide for  joint

     1  enforcement  of  the provisions of this section by agreement pursuant to
     2  article five-G of the general municipal law.
     3    5.  The  state fire prevention and building code council is authorized
     4  to establish, through regulation  or otherwise, any additional  training
     5  requirements  for  all  code enforcement officials related to the safety
     6  and security of grease traps or interceptors in food service  establish-
     7  ments.
     8    §  3.  The  public  authorities law is amended by adding a new section
     9  2858 to read as follows:
    10    § 2858. Public water and sewer authority powers.  A  public  water  or
    11  sewer authority, created pursuant to article five of this chapter, shall
    12  have  the  power to specify the manner in which exterior manhole covers,
    13  containing grease traps or interceptors shall be regulated and inspected
    14  to prevent unauthorized access.
    15    § 4. This act shall take effect on the ninetieth day  after  it  shall
    16  have become a law. Effective immediately, the addition, amendment and/or
    17  repeal  of  any  rule  or regulation necessary for the implementation of
    18  this act on its effective date are authorized to be made  and  completed
    19  on or before such effective date.
