MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A29A SPONSOR: Rosenthal L
  TITLE OF BILL: An act to amend the social services law, in relation to requiring the anchoring of furniture and electronics in child day care centers and certain other facilities   PURPOSE: This bill protects children at child care centers and foster.,care agen- cies from the tipping of unsecured furniture.   SUMMARY OF PROVISIONS: -Outlines the child care facilities and foster care agencies covered under the legislation -Requires large furniture and electronics to be properly secured within aforementioned facilities -Authorizes the Office of Children and Family Services to take action if a child care center doesn't immediately correct a violation of this act   JUSTIFICATION: In 2013, Million Dollar Baby recalled 18,000 dressers and in 2016 Ikea. recalled 29 million dressers and chests due to the serious tipOter hazard that they possessed. Moreover, ASTM International, a standards crganization that publishes voluntary consensus technical standards, developed recommendations that furniture be sold with proper anchoring systems to prevent tip over accidents. According to the United States Consumer Product Safety Commission, every 24 minutes a child goes to the emergenby room with an injury resulting from a television or piece of furniture tipping over. From 2000 to 2013, 84 percent of the 430 deaths from furniture tipping over involved children younger than the age of 10. Despite the clear danger that furniture tipping over can present to our children and the relative ease in preventing these accidents, there are no requirements for anchoring heavy dressers or tube style televisions in child care centers throughout New York State. This legislation would ensure that when we send our children to child care, they are safe from this all too common hazard by requiring that child care facilities prop- erly secure or anchor furniture and televisions to the wall. Such a requirement will require a minimal financial investment by daycare centers and could save significant sums of money by preventing emergency room visits.   LEGISLATIVE HISTORY: 2017-18: A.5284-C - Passed Assembly; S.3667-C - Reported to Finance   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This act shall take effect'180 days after it shall have become a law.

ROSENTHAL -- read once and referred to the Committee on Children and Families -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the social services law, in relation to requiring the anchoring of furniture and electronics in child day care centers and certain other facilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The social services law is amended by adding a new section 2 390-l to read as follows: 3 § 390-l. Securing of furniture. 1. This section shall apply to any 4 child day care center as defined in paragraph (c) of subdivision one of 5 section three hundred ninety of this title, or any authorized agency as 6 defined in paragraph (a) of subdivision ten of section three hundred 7 seventy-one of this title, including any agency boarding home or group 8 home. 9 2. Any facility to which this section applies shall take measures to 10 securely anchor to the floors or walls of such facility all items of 11 large furniture and all electronic appliances capable of being tipped 12 over due to design, height, weight, stability or other features, using 13 angle-braces, anchors or other anchoring devices. Any item of furniture 14 or electronic device which cannot be so anchored shall be removed from 15 the facility. 16 3. If a violation of the provisions of this section is discovered by 17 the office of children and family services or any local social services 18 district authorized to inspect the facility at which the violation 19 occurs, the agency discovering the violation shall provide written 20 notice of the violation to the operator of the facility and to the 21 office of children and family services if such office is not the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01860-02-9A. 29--A 2 1 inspecting agency within ten calendar days of the discovery of the 2 violation. The operator of the facility shall correct the violation 3 immediately, upon notice. If the violation is not corrected, the office 4 of children and family services may take enforcement action in accord- 5 ance with the applicable sections of state law. 6 § 2. This act shall take effect on the one hundred eightieth day after 7 it shall have become a law. Effective immediately, the addition, amend- 8 ment and/or repeal of any rule or regulation necessary for the implemen- 9 tation of this act on its effective date are authorized and directed to 10 be made and completed on or before such effective date.
