NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

SPONSOR: Bores
  TITLE OF BILL: An act to amend the election law, in relation to the dates to file a designating petition; and providing for the repeal of such provisions upon expiration thereof   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to change the dates of petition filing to allow observant Jewish candidates and staff to file without interfering with Passover.   SUMMARY OF PROVISIONS: Section one of the bill would establish that for 2023, designating petitions must be filed not earlier than the thirteenth Monday before and not later than the twelfth Monday preceding the primary election. This would allow petitions to be filed between April 3, 2023 and April 10, 2023. Section two of the bill would establish that for 2023, any signatures for a designating petition made earlier than 41 days before the last day to file designating petitions for the primary election (February 28, 2023) or made later than the twelfth Thursday preceding the primary election (April 6, 2023) shall not be counted. Section three would establish the effective date.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): The B-print amendments provide that a signature made later than the twelfth Thursday preceding the primary election (April 6, 2023) shall not be counted.   JUSTIFICATION: The current deadline to file petitions would prevent observant Jewish candidates from filing and interfere with seders, as it overlaps with the first day of Passover. This act would shift the filing deadline for this year, ensuring New Yorkers of all faiths can participate equally in the electoral process.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This bill would take effect immediately and expire on December 31, 2023.
