TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
granting members or officers of the state police credit for service as a
deputy sheriff, county corrections officer, or state corrections officer
 
PURPOSE:
This bill provides up to two years of service credit for service
rendered as a deputy sheriff, county correction or state correction to
be creditable to State Police Officers.
 
SUMMARY OF PROVISIONS:
Section 1 amends chapter 581 of the laws of 2001 of the retirement and
social security law and adds a new paragraph to include member s or
officers of the state police credit for more than seventeen years of
service as a deputy sheriff, county corrections officer, or state
corrections officer.. Each member or officer will receive one year of
service credit for each year of previous service. The member or officer
may not exceed two years of previous service credit. Section 2 is the
effective date.
 
JUSTIFICATION:
Members of the New York State Police are eligible to receive a service
credit towards their retirement for having served as a police officer,
member of a local police force, member of the state park authority, or
as a participating member of the capital police force in the office of
general services. This legislation will expand the current law and
enable eligible state police officers to buy up to two years of addi-
tional pension credit for their past service as a deputy sheriff, county
corrections officer, or state corrections officer.

FISCAL IMPLICATIONS:
It is estimated that the past service cost will average approximately
22% of an affected officers' compensation for each year of additional
service credit that is purchased and will be borne entirely by the
state. The fiscal note also recommends-obtaining a ruling on plan quali-
fication issues from the Internal Revenue Service at a cost of $28,000
and $800 per hour for legal consultants.
