TITLE OF BILL:
An act to amend the civil service law, in relation to preventing

PURPOSE OR GENERAL IDEA OF BILL:
To prevent outsourcing during a hiring freeze.
 
SUMMARY OF PROVISIONS:
Section 1. Establishes that no entity under the control of the executive
shall contract, subcontract, or hire any third party during a hiring
freeze.
Section 2. Establishes an effective date.
 
JUSTIFICATION:
There are currently more than 5,000 vacant full-time equivalent state
positions, many of which are critical positions that would normally
provide middle-class incomes to hard working state residents. These
positions have remained unfilled because of a hiring freeze put in place
by the Governor. In order to ameliorate service deficiencies caused by
the filling of these positions, the Governor has started to outsource
services that would normally be carried out by the state's workforce.
This could result in the permanent displacement of state jobs that
provide state residents with a means of achieving a middle-class life.
This bill would preserve the economic opportunities these positions
provide by prohibiting the outsourcing of services that would otherwise
be performed by the state's unionized workforce.

AN ACT to amend the civil service law, in relation to preventing
outsourcing during a hiring freeze
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The civil service law is amended by adding a new section 66
2 to read as follows:
3 § 66. Hiring freeze. Upon the enactment of a hiring freeze, no agency,
4 department, division, commission, bureau or any other entity under the
5 authority of the executive department shall contract, subcontract or
6 hire any third party to perform services that would otherwise be carried
7 out by an employee whose terms of employment are subject to a collective
8 bargaining agreement or other analogous contract and who is subject to
9 such hiring freeze.
10 § 2. This act shall take effect immediately.
