MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the public housing law, in relation to requiring enti- ties responsible for the provision of vital services to coordinate and work expeditiously to restore service whenever such service is inter- rupted   PURPOSE: The purpose of this legislation is to include gas alongside other vital services about which the New York City Housing Authority ("NYCHA") must publish public information regarding reported disruptions, -the length of such disruption and the steps taken to restore services. The bill further NYCHA to remedy any such interruptions as expeditiously as possible and coordinate with agencies and gas corporations on a plan to restore such service.   SUMMARY OF PROVISIONS: Section 1 amends subdivision 1 of section 402-e of the public housing law, as amended by chapter 47 of the laws of 2020, by adding gas to the list of vital services on which NYCHA is required to publish regular updates, and adds a new subdivision 5 that requires NYCHA coordinate and work expeditiously to restore service whenever it is required to be interrupted. Section 2 provides for the effective date.   JUSTIFICATION: As of August 2021, 56 NYCHA developments across New York City' are expe- riencing gas outages, some of which have lasted for several months or longer. Like electricity, heat, water and working elevators, gas is a vital service that enables residents to prepare their own food safely and- especially during a pandemic- minimize unnecessary contact with takeout and delivery food options. Because restoration of this essential service can often take months, affected residents, not only incur addi- tional food costs, they are forced to work with inadequate replacement equipment like hotplates for an inordinate amount of time. This legis- lation aims to protect NYCHA residents from these hardships by creating an incentive for public authorities, city and state agencies, and utili- ty companies to work together quickly and efficiently to restore vital gas service to residents experiencing an outage.   LEGISLATIVE HISTORY: 2021-22 A.9587 Referred to Housing / S.7357 COMMITTED TO RULES   FISCAL IMPLICATIONS: To be determined.   EFFECTIVE DATE: This act shall take effect on the one hundred eightieth day after it shall have become law.

Paragraph (a) of subdivision 1 of section 402-e of the 2 public housing law, as amended by chapter 645 of the laws of 2023, is 3 amended and a new subdivision 5 is added to read as follows: 4 (a) In order to ensure compliance and enforcement of the New York city 5 housing authority's duty to provide heat, water, electricity, gas, where 6 provided and elevator service, the New York city housing authority shall 7 publish information regarding reported disruptions in such services, the 8 length of such disruptions and the steps taken to restore services and 9 shall remedy interruptions of gas service in accordance with subdivision 10 five of this section. Starting on May first, two thousand twenty, the 11 New York city housing authority shall publish such information on its 12 website. For six months after the original publication date, the New 13 York city housing authority shall retain such information on its 14 website. 15 5. (a) The New York city housing authority shall remedy an inter- 16 ruption of gas service as expeditiously as practicable by applying for 17 any permits necessary to make repairs, as applicable, and coordinating 18 with agencies and gas corporations on a plan to restore such service. LBD01991-04-4A. 3866--B 2 1 (b) The New York city housing authority shall notify residents 2 affected by any such interruption of the plan to restore such service 3 developed pursuant to paragraph (a) of this subdivision by: 4 (i) Communicating such plan to residents affected by such interruption 5 as well as the resident association president or other formally recog- 6 nized resident leader; 7 (ii) Regularly scheduling meetings to update residents affected by 8 such interruption, as well as the resident association president or 9 other formally recognized resident leader, about the progress made on 10 such plan; and 11 (iii) Posting a notice in the lobby of the building affected by such 12 interruption describing the interruption and estimating the date on 13 which service by the gas corporation shall be restored. 14 § 2. This act shall take effect on the one hundred eightieth day after 15 it shall have become a law.
