TITLE OF BILL:
An act to amend the state finance law, in relation to requiring the
construction of certain parking facilities to be capable of supporting
electric vehicle charging stations
 
PURPOSE:
This legislation requires any parking garage or parking lot capable of
accommodating between fifty and two hundred cars that receives state
capital funding to be capable of supporting electric vehicle charging
stations
 
SUMMARY OF PROVISIONS:
Section 1 requires any parking garage or parking lot that receives state
capital funding to be capable of supporting electric vehicle charging
stations. Specifically requires the electrical raceway and all compo-
nents be up to all applicable code. Specifically it shall provide a
minimum 3.1 kW of electrical capacity to each charging station when
connected. Parameters are set for parking facilities capable of accommo-
dating between fifty and two hundred cars and parking facilities capable
of accommodating over two hundred cars. This specifies that there no is
mandate to install the electrical charging stations themselves, but just
to install the infrastructure necessary for future charging stations.
Section 2 is the effective date.
 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION:
Added a definition of construction project for the purposes of this
bill; set parameters for applicable parking facilities which include
between fifty and two hundred parking spaces and over two hundred park-
ing spaces to be capable of supporting electric vehicle charging
stations for a minimum of ten percent of available spaces and a minimum
of twenty percent, respectively; and made conforming and technical
changes to language.
 
JUSTIFICATION:
As New York embarks on its impressive and necessary climate goals, we
must look at ways to increase capacity for those individuals who seek to
purchase and use electric vehicles. One of the major complaints from
electric car owners is the lack of public charging stations available to
them. This legislation seeks to address this concern by requiring enti-
ties that receive state capital funding to install the infrastructure
necessary for electric car charging stations. This legislation does not
mandate the installation of the stations themselves but to be forward
thinking in requiring the installation of the infrastructure. It is
significantly more costly to install the necessary infrastructure for
charging stations after the completion of a parking garage or lot, by
requiring this to be done up front significant cost savings can be real-
ized.

AN ACT to amend the state finance law, in relation to requiring the
construction of certain parking facilities to be capable of supporting
electric vehicle charging stations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The state finance law is amended by adding a new section
2 19-a to read as follows:
3 § 19-a. Parking facilities; support for electric vehicle charging
4 stations. 1. For purposes of this section the term "construction
5 project" shall mean any construction project performed under private
6 contract that receives state capital funding.
7 2. Any construction project undertaken in this state where the scope
8 of such project includes a parking garage, open parking lot, or other
9 parking facility that offers between fifty and two hundred parking spac-
10 es shall be capable of supporting electric vehicle charging stations for
11 a minimum of ten percent of available parking spaces through an elec-
12 trical raceway to the electric supply panel serving such parking garage,
13 open parking lot, or other parking facility that shall be capable of
14 providing a minimum of forty amps and two hundred eight volts of elec-
15 trical capacity to each charging station connected to the raceway. Such
16 raceway and all components and work appurtenant thereto shall be in
17 accordance with all applicable state, city and municipal electrical
18 codes.

1 3. Any construction project undertaken in this state where the scope
2 of such project includes a parking garage, open parking lot, or other
3 parking facility that offers more than two hundred parking spaces shall
4 be capable of supporting electric vehicle charging stations for a mini-
5 mum of twenty percent of available parking spaces through an electrical
6 raceway to the electric supply panel serving such parking garage, open
7 parking lot, or other parking facility that shall be capable of provid-
8 ing a minimum of forty amps and two hundred eight volts of electrical
9 capacity to each charging station connected to the raceway. Such raceway
10 and all components and work appurtenant thereto shall be in accordance
11 with all applicable state, city and municipal electrical codes.
12 4. Nothing in this section shall require the installation of electric
13 vehicle charging stations in any parking garage, open parking lot or
14 other parking facility.
15 5. Any construction project undertaken pursuant to subdivisions two
16 and three of this section shall comply with the provisions of article
17 eight of the labor law, including the payment of a wage of not less than
18 the prevailing wage pursuant to section two hundred twenty of the labor
19 law in the locality where such parking garage, open parking lot, or
20 other parking facility is located.
21 § 2. This act shall take effect April 1, 2023 and shall apply to
22 contracts for new construction entered into on and after such date.
