A05948 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A5948

SPONSOR: Shimsky
TITLE OF BILL: An act to amend the navigation law, in relation to equipment to be carried on vessels   PURPOSE OR GENERAL IDEA OF BILL: To align state law with federal standards regarding safety equipment on recreational vessels, including the use of whistles and fire extin- guishers, to promote boating safety.   SUMMARY OF SPECIFIC PROVISIONS: Section one of this bill would amend subdivision 2 of section 40 of the Navigation Law to require every vessel, including rowboats, canoes, and kayaks, to have_a whistle on board for use in an emergency. Section two of this bill would amend subdivision 6 of section 40 of the Navigation Law to update the type and number of fire extinguishers required to be on board certain mechanically propelled vessels.Disposable fire extinguishers over 12 years old would have to be replaced. Section three of this bill would add a new subdivision 13 of Section 40 of the Navigation law to require vessels under 26 feet that are equipped with an engine cut-off switches to use such when operating on plane or above displaced speed. Section four would establish the effective date.   JUSTIFICATION: Boater safety is important to reduce the risk of personal injury and property damage due to boating accidents.Ensuring that recreational vessels have working unexpired fire extinguishers on board will prevent serious injury in the event of a fire. The United States Coast Guard updated Federal regulations on April 20, 2022 with regard to recreation- al vessels of model year 2018 and newer to carry new and unexpired fire extinguishers. This bill would create parity between the Federal regu- lations and New York state law in order to promote boater safety.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This bill would take effect January 1, 2024.
