MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A8630A SPONSOR: Reyes
  TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting cosmetic products and personal care products that contain mercury   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to prohibit the sale or offer for sale of any cosmetic product or personal care product containing mercury.   SUMMARY OF PROVISIONS: Section 1 of this bill would amend section 37-0117 of the environmental conservation law to prohibit the sale or offer for sale any cosmetic product or personal care product containing mercury. Mercury would be defined to mean elemental mercury Hg, mercuric iodide, mercury oxide, mercurous chloride, ethyl mercury, phenyl mercuric salts, ammoniated mercury, amide chloride of mercury, mercury sulfide or cinnabaris, or mercury iodide. Section 2 of this bill provides that the bill shall take effect June 1, 2023.   JUSTIFICATION: Advertisers and marketers often promote and reinforce a bias toward lighter, more Caucasian skin tones as a more desirable beauty standard. Striving to reach these unattainable ideals, people of color are purchasing skin lightening products contributing to a now developing billion-dollar international industry, estimated to be worth $31.2 billion by 2024. Skin-lightening products do not just subconsciously perpetuate a beauty ideal based in colorism, which is the practice of showing preference to those of a lighter skin color within groups of people of the same race or ethnic background, but also these cosmetics and creams also contain toxic ingredients. When absorbed in the skin, it can cause kidney damage, skin rashes, psychosis, skin discoloration, and peripheral neuropathy. Mercury is the main ingredient used in skin- lightening products to stop the production of melanin. Manufacturers place mercury in cosmetics to fade dark spots, blemishes, fine lines, and lighten skin. However, mercury has a high absorption rate that can quickly damage skin and even organs. This bill would ban the sale or offer for sale of any cosmetics products or personal care products containing mercury. The Legislature has previ- ously prohibited other products that contain mercury, such as in certain dental products and in thermostats.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   BUDGET IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect June 1, 2023.

The section heading of section 37-0117 of the environmental 2 conservation law, as amended by chapter 44 of the laws of 2020, is 3 amended and a new subdivision 8 is added to read as follows: 4 Prohibition of cosmetic products and personal care products containing 5 1,4-dioxane or mercury. 6 8. No person shall sell or offer for sale any cosmetic product or 7 personal care product containing mercury. For the purposes of this 8 subdivision "mercury" shall mean elemental mercury Hg, mercuric iodide, 9 mercury oxide, mercurous chloride, ethyl mercury, phenyl mercuric 10 salts, ammoniated mercury, amide chloride of mercury, mercury sulfide or 11 cinnabaris, or mercury iodide. 12 § 2.
