AN ACT authorizing alienation of certain parklands in the town of Corn-
wall, county of Orange
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, the town of Corn-
2 wall, in the county of Orange, acting by and through its town board, is
3 hereby authorized to discontinue as parklands and alienate the lands
4 described in section three of this act for the purpose of constructing a
5 local history museum owned and operated by the town of Cornwall.
6 § 2. The authorization contained in section one of this act shall take
7 effect only upon the condition that the town of Cornwall dedicate an
8 amount equal to or greater than the fair market value of the parcel
9 described in section four of this act for the acquisition of additional
10 park and recreational facilities and/or for capital improvements to
11 existing park and recreational facilities.
12 § 3. The authorization contained in section one of this act shall be
13 conditioned upon use of the lands described in section four of this act
14 exclusively for the purpose of construction and operation of a local
15 history museum by the town of Cornwall and, in the event that such use
16 of the said land by the town shall cease, the lands described in section
17 three of this act shall revert to parkland owned and maintained by the
18 town.
19 § 4. The lands authorized by section one of this act to be discontin-
20 ued as parkland are described as follows:
21 ALL that certain plot, piece or parcel of land with the building and
22 improvements thereon erected, situate, lying and being in the Town of

1 Cornwall, County of Orange and State of New York bounded and described
2 as follows:
3 BEGINNING at a point in or near a utility pole at the southeasterly
4 corner of lands of the Central School District No. 1 of the Towns of
5 Cornwall, New Windsor and Woodbury as described in Liber 4750, Page 330,
6 said point of beginning being located South 33 degrees 36 minutes 27
7 seconds East for a distance of 342.24 feet along the northeasterly
8 bounds of said parcel, from a point in the southeasterly line of Hudson
9 Street;
10 THENCE South 33 degrees 36 minutes 27 seconds East for a distance of
11 100.68 feet through lands of the Town of Cornwall, Liber 2028, Page 337
12 to a point;
13 THENCE South 49 degrees 43 minutes 32 seconds West for a distance of
14 191.00 feet through the same to a point in or near the edge of pavement
15 of Munger Cottage Drive;
16 THENCE North 33 degrees 29 minutes 19 seconds West for a distance of
17 135.22 feet through said lands of the Town of Cornwall to a point in the
18 southeasterly bounds said lands of Central School District No. 1 of the
19 Towns of Cornwall, New Windsor and Woodbury;
20 THENCE North 76 degrees 55 minutes 00 seconds East for a distance of
21 75.00 feet along the same to a point;
22 THENCE North 49 degrees 43 minutes 32 seconds East for a distance of
23 120.00 feet along the same to the POINT OR PLACE OF BEGINNING.
24 TOGETHER with and subject to covenants, easements, and restrictions of
25 record.
26 Said property contains 0.4661 acres more or less.
27 § 5. In the event that the town of Cornwall received any funding,
28 support or assistance from the federal government for the purchase,
29 maintenance or improvement of the parkland set forth in section three of
30 this act, the discontinuance and alienation of such parkland authorized
31 by the provisions of section three of this act shall not occur until the
32 town of Cornwall has complied with any federal requirements pertaining
33 to the alienation or conversion of such parklands, including satisfying
34 the secretary of the interior that the alienation or conversion complies
35 with all conditions which the secretary of the interior deems necessary
36 to assure the substitution of other lands shall be equivalent in fair
37 market value and usefulness to the lands being alienated or conveyed.
38 § 6. This act shall take effect immediately.
