        Introduced  by  Sen. TEDISCO -- read twice and ordered printed, and when

        AN  ACT  authorizing the city of Schenectady to alienate certain parcels
          of land used as parkland and to  acquire  other  parcels  of  land  to
          replace such parkland
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subject to the provisions of this act, the city of Schenec-
     2  tady, acting by and through its governing body, is hereby authorized  to
     3  discontinue  as  parklands  and  alienate  the  lands  more particularly
     4  described in section three of this act, and  to  sell  and  convey  such
     5  parklands  upon  such  other  terms  and conditions as determined by the
     6  governing body of the city of Schenectady to the Boys & Girls  Club  for
     7  the purpose of constructing a new Boys & Girls Club facility at Quacken-
     8  bush Park.
     9    § 2. The authorization contained in section one of this act shall take
    10  effect  only  upon  the  condition  that  the  city of Schenectady shall
    11  acquire and dedicate the lands of equal or  greater  fair  market  value
    12  described  in  section  four  of this act as additional parklands of the
    13  city.
    14    § 3. The lands authorized by section one of this act to be  discontin-
    15  ued  as parklands and conveyed to the Boys & Girls Club consists of 1.35
    16  acres and are described as follows:
    17    All that certain tract, piece, or parcel of land  situate,  lying  and
    18  being in the City of Schenectady, County of Schenectady and State of New
    19  York and being more particularly bounded and described as follows:
    20    Beginning at a point on the division line of lands herein described as
    21  Lot  1 on the south and lands now or formerly of Schenectady City School

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  District as described in Liber 279 of deeds at page 209  on  the  north,
     2  said  point  being  the  northeast corner of Lot 2; thence running along
     3  said division line North 30°59'00" East, 150.10 feet to a point with the
     4  lands  herein  described as Lot 1 on the south, lands now or formerly of
     5  Schenectady City School District on the west and lands now  or  formerly
     6  of  the  City  of Schenectady as described in Liber 222 of deeds at page
     7  479 on the east; thence South 53°08'09" East, 151.20 feet to a point  on
     8  the  division  line  of  lands herein described as Lot 1 on the west and
     9  lands now or formerly of The City of Schenectady  on  the  east;  thence
    10  running  along said division line South 12°44'55" East, 195.16 feet to a
    11  point on the division line of lands herein described as  Lot  1  on  the
    12  north  and lands now or formerly of The City of Schenectady as described
    13  in Liber 302 of deeds at page 18 on the south; thence running along said
    14  division line South 78°47'04" West, 271.14 feet to a point at its inter-
    15  section with lands herein described as Lot 1 on the east, lands of Lot 2
    16  on the west and the lands now or formerly of The City of Schenectady  on
    17  the south; thence running along the division line of Lot 1 and Lot 2 the
    18  following  four  (4)  courses  and  distances: 1.) North 11°11'16" West,
    19  90.73 feet to a point; 2.) North 78°47'04" East, 42.99 feet to a  point;
    20  3.) North 11°12'56" West, 49.48 feet to a point; and 4.) North 09°19'00"
    21  East, 60.00 feet to the point or place of beginning.
    22    Containing 1.35 Acres of land more or less.
    23    § 4. The replacement lands to be acquired and dedicated by the city of
    24  Schenectady,  county  of  Schenectady, to use as new parkland for public
    25  park purposes are described as follows:
    26    All that certain piece or parcel of land situate in the City of  Sche-
    27  nectady,  County  of  Schenectady and the State of New York, lying along
    28  the westerly line of Crane Street, being further bounded  and  described
    29  as follows:
    30    Beginning  at a point located along the westerly line of Crane Street,
    31  further located 149.10 feet  northerly  from  the  northwesterly  inter-
    32  section  of  Crane  Street and Third Avenue, said point being the inter-
    33  section formed by said westerly line of Crane Street with  the  division
    34  line  between  the  lands  now or formerly of Wieslaw & Krystyna Cyrulik
    35  (Book 1518, Page 601) on the south and the lands herein described on the
    36  north and running along said division line of the following six courses:
    37  1) South 84°36'22" West, 137.39 feet to  a  point;  2)  South  84°36'22"
    38  West,  42.99  feet  to a point; 3) South 75°58'38" West, 32.19 feet to a
    39  point; 4) South  09°14'09"  East,  52.00  feet  to  a  point;  5)  South
    40  87°21'19" East, 2.50 feet to a point; and 6) South 02°24'08" East, 64.00
    41  feet to a point located on the northerly line of Third Avenue; thence in
    42  a  westerly  direction  and  along  said northerly line of Third Avenue,
    43  North 87°21'19" West, 74.87 feet to a point being the division  line  of
    44  lands  now or formerly of Mohanie Lallbachan (Book 1720, Page 70) on the
    45  west and the lands herein described on the east; thence in  a  northerly
    46  and westerly direction along said division line the following two cours-
    47  es:  1)  North  02°02'52"  West,  153.00  feet  to  a point and 2) South
    48  77°54'49" West, 40.00 feet to a point being the division line  of  lands
    49  now  or  formerly  of  Awadnarie Lallbachan (Book 1624, Page 802) on the
    50  west and the lands herein described on the east, thence in  a  northerly
    51  and westerly direction along said division line the following two cours-
    52  es:  1)  North  20°52'36"  West,  12.11  feet  to  a  point and 2) South
    53  89°00'29" West, 1.38 feet to a point; thence in  a  northerly  direction
    54  and along the division line of the lands now or formerly of George David

    28  and  the  lands  herein  describe on the west; thence in a southerly and
    29  easterly direction and along aforesaid division line the following  four
    30  courses:  1)  South  08°27'34"  East,  38.40  feet  to a point, 2) North
    31  81°32'26" East, 19.10 feet to a point, 3) North  82°49'53"  East,  26.10
    32  feet  to  a point and 4) North 88°22'48" East, 145.72 feet to a point on
    33  the westerly line of Crane Street; thence in a southerly  direction  and
    34  along  said  westerly  line of Crane Street, South 02°14'18" West, 68.50
    35  feet to a point being the division line of the lands now or formerly  of
    36  Frank Leszczynski, Jr. and Zita Leszczynski (Book 1618, Page 459) on the
    37  south and the lands herein described on the north; thence in a westerly,
    38  southerly  and  easterly direction and along aforesaid division line the
    39  following four courses: 1) South 86°51'49" West, 153.36 feet to a point;
    40  2) South 12°46'42" East, 70.00 feet to a point; 3) North 78°27'18" East,
    41  72.00 feet to a point and 4) North 79°19'18" East, 66.30 feet to a point
    42  on the westerly line of Crane Street; thence in  a  southerly  direction
    43  and  along  said  westerly  line  of Crane Street, South 02°14'18" West,
    44  77.23 to the point or place of beginning.
    45    Containing in all 2.03 acres of land being more or less.
    46    § 5. In the event that the parklands to be dedicated by  the  city  of
    47  Schenectady  pursuant  to  this act are not equal to or greater than the
    48  fair market value of the parkland to be discontinued and  conveyed,  the
    49  city  of  Schenectady  shall  dedicate the difference of the fair market
    50  value of the lands to be alienated and the lands to be dedicated for the
    51  acquisition of additional parklands and/or for capital  improvements  to
    52  existing park and recreational facilities.
    53    §  6.  In  the event that the city of Schenectady received any funding
    54  support or assistance from the  federal  government  for  the  purchase,
    55  maintenance  or  improvement of the parklands set forth in section three
    56  of this act, the discontinuance and alienation of such parkland  author-

     1  ized  by  the  provisions  of this act shall not occur until the city of
     2  Schenectady has complied with any federal requirements pertaining to the
     3  alienation or conversion of such  parklands,  including  satisfying  the
     4  secretary  of  the  interior  that the alienation or conversion complies
     5  with all conditions which the secretary of the interior deems  necessary
     6  to  assure  the  substitution of other lands shall be equivalent in fair
     7  market value and usefulness to the lands being alienated or converted.
     8    § 7. This act shall take effect immediately.
