        Introduced  by  Sen.  CANZONERI-FITZPATRICK  --  read  twice and ordered
          printed, and  when  printed  to  be  committed  to  the  Committee  on
          Commerce, Economic Development and Small Business
 
        AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
          license to sell liquor at retail for consumption on certain premises

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-15)  to  read  as
     3  follows:
     4    (e-15)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied as a church, synagogue  or  other  place  of
     8  worship,  provided  such  premises constitute a premises for the sale of
     9  food or beverages at retail for  consumption  on  the  premises  located
    10  wholly  within  the boundaries of the village of Malverne, town of Hemp-
    11  stead, county of Nassau, state of New York being Lots  4,  5,  7  and  a
    12  portion of Lots 3 and 6 on a certain map entitled "Map No. 2 of Malverne
    13  Estates  situate  at  Malverne,  L.I. adjoining Lynbrook, Nassau County,
    14  N.Y. owned by Amsterdam Development and Sales Co. Inc.,  1269  Broadway,
    15  534  6th Avenue, N.Y.C.  surveyed and mapped by Fairfield and Dow, Engi-
    16  neers, Mineola, N.Y. April 1914" bounded and described as follows:
    17    ALL THOSE CERTAIN plots, pieces or parcels of land, with  improvements
    18  thereon,  situate,  lying  and being on Hempstead Avenue, in the city of
    19  Malverne, county of Nassau, state of New  York,  all  more  particularly
    20  bounded and described as follows:
    21    BEGINNING  at  the  corner formed by the intersection of the northerly
    22  side of Nottingham Road with the new westerly side of Hempstead  avenue;
    23  running  thence  westerly along the northerly side of Nottingham Road on
    24  the arc of a curve concave to the north, having a radius of 28.00  feet,
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  a  central  angle of 24 degrees 16 minutes and a chord distance of 11.77
     2  feet which bears north 80 degrees 26 minutes  40  seconds  west,  thence
     3  westerly  along  the  arc of said curve a distance of 11.86 feet; thence
     4  north  68  degrees  22 minutes 07 seconds west still along the northerly
     5  side of Nottingham Road, a distance of  110.00  feet;  thence  north  21
     6  degrees  37  minutes  53 seconds east, a distance  of 99.65 feet; thence
     7  south 67 degrees 41 minutes 01 seconds east, a distance of  20.00  feet;
     8  thence  south 21 degrees 37 minutes 53 seconds west, a distance of 49.41
     9  feet; thence south 68 degrees 22 minutes 07 seconds east, a distance  of
    10  117.95  feet  to  the westerly side of Hempstead Avenue; thence south 40
    11  degrees 42 minutes 30 seconds west along the westerly side of  Hempstead
    12  Avenue,  50.30  feet to the point of beginning. Said premises also known
    13  as 269 Hempstead Avenue, Malverne, N.Y.
    14    § 2. This act shall take effect immediately.
