A03807 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A3807A

SPONSOR: Cymbrowitz
TITLE OF BILL: An act to amend the public housing law, in relation to an affordable housing five-year capital plan   PURPOSE OR GENERAL IDEA OF BILL: To require a five-year capital spending plan for New York State Homes & Community Renewal (HCR) for the fiscal year beginning on April 1, 2022, and every fifth fiscal year thereafter.   SUMMARY OF PROVISIONS: Sec. 1 adds a new section 20-a to public housing law. Subsection 1 requires that, for the fiscal year beginning on April 1, 2022, and every fifth fiscal year thereafter, the governor shall submit a statewide, comprehensive five-year capital plan to the Legislature to support the development, preservation and capital improvement of affordable housing in New York State. Subsection 2 sets forth minimum requirements for the spending plan proposal and requires that such proposal be developed in consultation with the relevant state agencies. Subsection 3 stipulates that semi-annually after the enactment of a five-year plan, HCR must submit and make publicly available information summarizing the activities undertaken using the funding made available in the enacted plan.   JUSTIFICATION: As the State reaches the close of its five-year affordable and support- ive housing plans, there is a growing uncertainty among developers of these much-needed units about the future of projects still in conception and in the pipeline, many of which could be abandoned without the prom- ise of available funding in coming years. A five-year capital plan with annual appropriations for critical programs would provide the State's affordable housing providers with the ability to plan and continue their vital work to meet the affordable housing needs of New York State's residents.   PRIOR LEGISLATIVE HISTORY: 2020: A10576 (Cymbrowitz) - RULES/Housing - S8488 (Kavanagh)   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: Immediately.
