A04614 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A4614

SPONSOR: Fahy
TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to certificates of registration for entities that manufacture or assemble zero emissions vehicles and have no franchised motor vehicle dealers in New York   PURPOSE: To increase the certificates of registration for entities that manufac- ture or assemble zero emissions vehicles to open sales locations in New York State   SUMMARY OF PROVISIONS: Section 3.: Removes the limit on the number of certificate of registra- tions the Commissioner of Motor Vehicles may issue and renew to manufac- turers that manufacture or assemble exclusively zero emission vehicles (ZEVs) and adds the requirement that an eligible manufacturer must not have a franchised motor vehicle dealer of the same line-make in the State. Section 2: This act shall take effect immediately.   JUSTIFICATION: Currently, New York law only allows five electric vehicle (EV) direct sales locations throughout the State. Due to overwhelming demand, these stores are all located downstate, leaving upstate residents without convenient and accessible locations to purchase zero-emission vehicles (ZEVs), and preventing any additional electric vehicle companies from opening stores in the State. The Climate Leadership and Community Protection Act (CLCPA) requires the State to achieve a carbon-free electricity system by 2040, and codifies the goals of a 40% reduction in greenhouse gas (GHG) emissions from 1990 levels by 2030, and 85% by 2050. Additionally, the Governor has set the goal of having 850,000 EVs on the road by 2025, and two million EVs by 2030 through the 2014 Multi-State ZEV Memorandum of Understanding (MOU). As of September 2020, New York had only achieved 3% of the 2025 goal. New York cannot meet these goals and targets without increased adoption of electric vehicles. Allowing more direct sales locations from multiple EV manufacturers will increase near-term economic investment and employ- ment opportunities in retail and service locations and make it easier for New Yorkers across the state to purchase electric vehicles.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None   EFFECTIVE DATE: Immediately.
