MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the election law, in relation to authorizing registra- tion records of victims of sexual violence to be kept confidential in certain cases   PURPOSE: This bill allows victims of a crime as defined in article 30 of the penal law protection against their attacker by enabling them to have their voter records sealed. The victim can do this by applying to the Board of Elections for the county where the victim is registered, who may then require confidentiality of the records.   SUMMARY OF PROVISIONS: Section One amends section 5-508 of the election law, to add victims of victims of a crime as defined in article 30 of the penal law to those eligible for confidentiality of election registration records. Section Two is the effective date.   JUSTIFICATION: Under current law, victims of domestic violence may apply to the Board of Elections to have their voter records kept confidential. Upon receipt of this request, the Board of Elections may issue an order that the victim's information will be kept separate from the records which are available for public inspection. This bill extends that protection to victims a crime as defined in arti- cle 30 of the Penal Law of to whom anonymity is not currently provided. It is equally important for victims of these heinous crimes to be protected from their attackers, and this legislation closes the gap in the current law to allow sexual violence victims the same protection as victims of domestic violence so that they too can feel secure in regis- tering to vote.   LEGISLATIVE HISTORY: 2019-20: S.257/A.7617 Passed Senate 2017-18: S.1445/A.8000 2015-16: S.3131/A.5563 2014-15: S.1685/A.8902 2011-12: S.40738 of 2011-2012; Passed Senate 2010: S.7424B/A.11014A   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made on or before such date.

        AN ACT to amend the election law, in relation to  authorizing  registra-
          tion  records of victims of sexual violence to be kept confidential in
          certain cases
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (a)  of  subdivision 2 of section 5-508 of the
     2  election law, as amended by chapter 521 of the laws of 2021, is  amended
     3  to read as follows:
     4    (a)  A  victim of domestic violence or any person who is a victim of a
     5  crime defined in article one hundred thirty of the penal law may deliver
     6  to the board of elections, in the county wherein such victim of domestic
     7  violence or victim of a crime defined in article one hundred  thirty  of
     8  the penal law is registered or intends to be registered pursuant to this
     9  article,  in  person  or by mail, a signed written statement swearing or
    10  affirming:
    11    (i) that such person is the victim of domestic violence or victim of a
    12  crime defined in article one hundred thirty of the penal law; and
    13    (ii) that because of the threat of physical or emotional harm to them-
    14  self or to family or household members, such  person  wishes  for  their
    15  registration record to be kept confidential.
    16    § 2. This act shall take effect on the one hundred twentieth day after
    17  it  shall have become a law. Effective immediately, the addition, amend-
    18  ment and/or repeal of any rule or regulation necessary for the implemen-
    19  tation of this act on its effective date are authorized to be made on or
    20  before such date.
