NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A7022

SPONSOR: Wallace
TITLE OF BILL: An act to amend chapter 462 of the laws of 2015, amending the elder law relating to long term care ombudsman access to assisted living facili- ties, in relation to the effectiveness of certain provisions of such chapter   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to extend certain provisions of the long term care ombudsman program for two years.   SUMMARY OF PROVISIONS: This bill would extend the authorization of the long term care ombudsman program to advocate on behalf of managed long term care participants until December 31, 2023.   JUSTIFICATION: The Long Term Care Ombudsman Program (LTCOP) is an important advocate for older adults in long term care facilities such as nursing homes, assisted living facilities, and adult homes. Currently the LTCOP is authorized to oversee managed long term care plans, but these provisions are set to expire on December 31, 2021. More study is needed to deter- mine the role of the LTCOP in relation to managed long term care plans to ensure older adults are receiving quality, appropriate care.   PRIOR LEGISLATIVE HISTORY: Chapter 214 of the laws of 2017.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect immediately.
