AN ACT to amend the labor law, in relation to including forward-facing
employment data in labor market information
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 12 of the labor law, as added by chapter 612 of the
2 laws of 1977 and subdivisions 2 and 7 as amended by chapter 301 of the
3 laws of 1996, is amended to read as follows:
4 § 12. Transmission of labor market information. 1. For the purposes
5 of this section:
6 a. Department means the department of labor of the state of New York.
7 b. Commissioner means the industrial commissioner of the state of New
8 York.
9 c. Education department means the education department of the state of
10 New York.
11 d. Labor market information is defined to include, but not be limited
12 to, industry and occupational projections for those standard metropol-
13 itan statistical areas for which the department compiles such informa-
14 tion and for the state of New York, "Applications and Openings" publica-
15 tion, and the "New York State Annual Planning Report", providing,
16 however, that the commissioner shall have the power to include addi-
17 tional publications, projections and other data to this definition of
18 labor market information.
19 e. Forward-facing employment data is defined to include, but not be
20 limited to, current and projected employment opportunities in the state
21 of New York, and shall include, but not be limited to, factors such as
22 geographical location or required training and experience for such
23 opportunities.
24 2. When it is jointly determined by the department and the education
25 department that labor market information or forward-facing employment
26 data prepared by the department is adequate in this prepared form, the
27 department shall transmit a copy of such information and data to: every
28 school district in the state of New York maintaining approved career

1 education programs, with a list of such school districts to be furnished
2 to the department by the education department; every board of cooper-
3 ative educational services maintaining approved career education
4 programs, with a list of such boards of cooperative educational services
5 to be furnished to the department by the education department; and every
6 community college and agricultural and technical institute in the state
7 of New York maintaining approved career education programs, with a list
8 of such colleges and institutes to be furnished to the department by the
9 education department. The education department shall regularly update
10 such lists to keep them current and transmit changes to the department
11 expeditiously.
12 3. The commissioner shall transmit to those school districts, boards
13 of cooperative educational services and community colleges and agricul-
14 tural and technical institutes located within a particular labor market
15 area, labor market information or forward-facing employment data
16 compiled for that area.
17 4. (a) The transmission of labor market information shall occur as
18 frequently as such labor market information is compiled or published by
19 the department, and in as expeditious a manner as possible following
20 such compilation or publication.
21 (b) The transmission of forward-facing employment data shall occur
22 bi-monthly, and in as expeditious a manner as possible following such
23 compilation or publication.
24 5. If a publication noted by title in this section shall be discontin-
25 ued by the department, the department shall transmit, pursuant to the
26 provisions of this section, the publication published by the department
27 which, in its opinion, provides the information most similar to that
28 information which had previously been provided by the discontinued
29 publication.
30 6. If a publication noted by title in this section shall have such
31 title changed, the department shall continue to transmit such publica-
32 tions with its new title.
33 7. When the department and the education department jointly determine
34 that labor market information or forward-facing employment data prepared
35 by the department, to be transmitted pursuant to this section, requires
36 an explanatory analysis to be utilized to its fullest potential, the
37 education department shall provide an analysis of the information or
38 data, written in clear, concise and easily understandable language. Such
39 analysis shall consider, but not be limited to a consideration of, the
40 following: instructions for the proper use of such information or data
41 by individuals involved in the planning and development of career educa-
42 tion, the proper use of such information or data by individuals involved
43 in vocational and educational guidance, and the proper use of such
44 information or data by current and prospective career education pupils
45 in the selection of career education programs likely to offer the great-
46 est potential for employment upon graduation.
47 8. To effectuate the purposes of this section, the commissioner and
48 the commissioner of education, or their authorized designees, shall meet
49 on a regular basis which shall not be less than once a month, excepting
50 July and August when such meeting shall be discretionary.
51 9. It shall be the responsibility of such school districts, boards of
52 cooperative educational services, and community colleges and agricul-
53 tural and technical institutes in receipt of such publications and
54 sources of labor market information or forward-facing employment data
55 enumerated in this section to provide copies of such labor market infor-
56 mation or forward-facing employment data to those individuals responsi-

1 ble for vocational and educational guidance at such school districts,
2 boards of cooperative educational services, community colleges and agri-
3 cultural and technical institutes.
4 § 2. This act shall take effect immediately.
