        Introduced  by  Sen. TEDISCO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT authorizing the city of Schenectady to alienate  certain  parcels
          of  land  used  as  parkland  and  to acquire other parcels of land to
          replace such parkland

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subject to the provisions of this act, the city of Schenec-
     2  tady,  Schenectady  county, acting by and through its governing body, is
     3  hereby authorized to discontinue the use  of  waterfront  parklands  and
     4  alienate such lands more particularly described in section three of this
     5  act,  for  the purpose of constructing and maintaining a pump station on
     6  such waterfront parklands, and upon such other terms and  conditions  as
     7  determined by the governing body of the city of Schenectady.
     8    § 2. The authorization contained in section one of this act shall take
     9  effect  only  upon  the  condition  that  the  city of Schenectady shall
    10  acquire and dedicate an amount equal to or greater than the fair  market
    11  value  of the waterfront parklands being discontinued towards the acqui-
    12  sition of new waterfront parklands and/or towards  capital  improvements
    13  to existing waterfront parkland and recreational facilities.
    14    § 3. The waterfront parklands authorized by section one of this act to
    15  be discontinued as parklands are described as follows:
    16  All that certain piece or parcel of land located in the City of Schenec-
    17  tady,  County  of  Schenectady, State of New York and being more partic-
    18  ularly bounded and described as follows:
    19  BEGINNING at a point on the westerly boundary of lands now  or  formerly
    20  of  the City of Schenectady, known as North Ferry Street Pumping Station
    21  (TM#39.55-1-38.2), at its intersection with the property  division  line
    22  between  lands now or formerly of Thomas Killeen (TM#39.55-1-22), on the
    23  south and other lands of the City of  Schenectady,  known  as  Riverside
    24  Park,  on  the north; thence South 58°-59'-05" West, along said property
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  division  line,  and  lands  now  of  formerly  of  Bradley  J.   Fisher
     2  (TM#39.55-1-21),   lands   now   of   formerly   of   Michael  J.  Petta
     3  (TM#39.55-1-20),  lands  now  of  formerly  of   St.   George's   Church
     4  (TM#39.55-1-19.2),   lands   now   of   formerly   of   Lynn   D.   Seal
     5  (TM#39.55-1-18),  and  lands  now  of  formerly  of  Ronald   J.   Chard
     6  (TM#39.55-117),  a  distance  of 231.35 feet to a point on the northerly
     7  terminus of Governors Lane, thence through said lands  of  the  City  of
     8  Schenectady, known as Riverside Park the following three (3) courses and
     9  distances:
    10    1. North 24°-12'-16" West, a distance of 59.35 feet to a point,
    11    2. North 13°-06'-35" West, a distance of 38.93 feet to a point, and
    12    3. North 58°-59'-05" East, a distance of 217.88 feet to a point on the
    13  property  division line between said lands now of the City of Schenecta-
    14  dy, known as North Ferry Street Pumping Station, on the  east  and  said
    15  lands  of the City of Schenectady, known as Riverside Park, on the west;
    16  thence South 27°-42'-47" East, along  said  property  division  line,  a
    17  distance  of  96.14  feet  to  the point or place of beginning and being
    18  21,780 square feet or 0.50 acres of land, more or less.
    19  Subject to all rights, easements, covenants or restrictions of record.
    20  Subject to any statement of facts that an up to date abstract  of  title
    21  would disclose.
    22    §  4.  In  the event that the city of Schenectady received any funding
    23  support or assistance from the  federal  government  for  the  purchase,
    24  maintenance  or  improvement of the parklands set forth in section three
    25  of this act, the discontinuance and alienation of such parkland  author-
    26  ized  by  the  provisions  of  section three of this act shall not occur
    27  until the city of Schenectady has complied with any federal requirements
    28  pertaining to the alienation or conversion of such parklands,  including
    29  satisfying  the secretary of the interior that the alienation or conver-
    30  sion complies with all conditions which the secretary  of  the  interior
    31  deems  necessary  to  assure  the  substitution  of other lands shall be
    32  equivalent in fair market value and usefulness to the lands being alien-
    33  ated or converted.
    34    § 5. This act shall take effect immediately.
