        AN ACT to amend the public health law, in relation to requests for tests
          for water contaminants by small public water suppliers

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public health law is amended by adding  a  new  section
     2  1111 to read as follows:
     3    §  1111.  Requests  for  tests  for water contaminants by small public
     4  water suppliers. 1. The department shall establish  a  list  of  contam-
     5  inants  consisting  of  the federally unregulated contaminants as desig-
     6  nated pursuant to the federal Safe  Drinking  Water  Act  (42  U.S.C.  §
     7  300g-1).
     8    2.  Any  small public water supplier may request that its water supply
     9  or source be tested for the list of contaminants set forth  in  subdivi-
    10  sion one of this section by the department. Provided, however, that such
    11  water  supply  or  source  is  not currently being tested by the federal
    12  environmental protection agency or any other federal agency  or  federal
    13  department  for  such contaminants. Within ninety days of receipt of the
    14  request, the department shall conduct such testing and provide the small
    15  public water supplier with the results. The cost of such  testing  shall
    16  be funded by the state. For the purposes of this section, a small public
    17  water  supplier shall be defined as a public water supplier which serves
    18  ten thousand people or fewer.
    19    3. The commissioner is hereby authorized and  directed  to  promulgate
    20  rules and regulations necessary for the implementation of this section.
    21    §  2.  This  act  shall take effect on the sixtieth day after it shall
    22  have become a law, provided, however, that  effective  immediately,  the
    23  addition,  amendment  and/or  repeal of any rule or regulation necessary
    24  for the implementation of this act on its effective date are  authorized
    25  to be made and completed on or before such date.
