NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6539

SPONSOR: Perry (MS)
TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to qualifications to become a member of the police force of the city of New York   PURPOSE: This bill will provide a temporary waiver of the 60-credit requirement for a period of five years for New York City auxiliary police officers who apply to the New York City Police Department and have served contin- uously as an auxiliary police officer for four or more years; fulfilled all other entrance requirements, including passing the entrance exam; and are enrolled in a two-year or four-year college or university in an associate or bachelor degree program.   SUMMARY OF PROVISIONS: Section 14-109 of the Administrative Code of the City of New York is amended by adding a new Subdivision c. This bill has the following four provisions: 1) Grants waiver to auxiliary police officers with four or more years service in the auxiliary police, or requires auxiliary applicant to be enrolled in a college degree program; 2) Provides five-year appointment as police officer with waiver; 3) Appointment converts to regular appointment on fulfillment of 60-cre- dit requirement; 4) Failure to fulfill 60-credit requirement terminates appointment at the end of five-years or allows for commissioner to grant extension or permanent appointment at his discretion.   JUSTIFICATION: Young men and women who care enough to volunteer their time and energy as New York City auxiliary police officers are worthy of special consid- eration when aspiring to serve as New York City police officers. Currently, however, there is a 60-credit educational eligibility requirement for individuals applying to become a New York City police officer. In an effort to provide auxiliary police officers with an access way into the New York City Police Department, this bill will establish a temporary waiver of the 60-credit requirement for a period of up to five years for auxiliary police officers applying to the posi- tion of police officer. The bill stipulates that the individual must have served continuously as an auxiliary officer for at least four years, have fulfilled all other entrance requirements, and is currently enrolled in a two- or four-year educational institution. The bill also stipulates that eligible auxiliary officers will receive a five-year appointment as a New York City police officer until proof of fulfillment of the educational requirement has been submitted. Auxilia- ry officers who do not fulfill the 60-credit requirement within the five year period will be subject to dismissal or other discretionary action taken by the commissioner.   PRIOR LEGISLATIVE HISTORY: 2013-2014 A4734 2011-2012 A3565 2009-2010 A3406 2007-2008 A4016 2005-2006 A.1400 2003-2004 A.5142 2001-2002 A.11889   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This Act shall take effect immediately after it shall have become a law.
