AN ACT to amend the education law, in relation to advertising on the
exterior sides of school buses
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 3638
2 to read as follows:
3 § 3638. Advertising on school buses. 1. The board of education of any
4 school district in the state may enter into a contract for the sale of
5 advertising space on the exterior sides of school buses owned or leased
6 by the school district, subject to the limitations set forth in this
7 section.
8 2. Advertisements for tobacco or alcohol products or for political
9 advocacy shall be prohibited, in addition to any other advertisements
10 for products or services or by sponsors that the commissioner deems
11 inappropriate.
12 3. All advertisements shall require prior approval by the local board
13 of education.
14 4. Revenue derived from advertisement contracts shall be retained by
15 the school district making such contract.
16 5. The provisions of this section shall not apply to cities with a
17 population of one million or more.
18 § 2. This act shall take effect on the sixtieth day after it shall
19 have become a law. Effective immediately, the addition, amendment and/or
20 repeal of any rule or regulation necessary for the implementation of
21 this act on its effective date are authorized and directed to be made
22 and completed on or before such effective date.
