MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)
 
BILL NUMBER: A111

  TITLE OF BILL: An act to amend the election law, in relation to publishing local campaign contribution limits   PURPOSE OR GENERAL IDEA OF BILL: To increase transparency and awareness regarding local campaign contrib- ution limits   SUMMARY OF SPECIFIC PROVISIONS: This bill amends section 14-114 of the Election Law to provide for local boards of election to calculate and publish on their websites by April 15th, the contribution limits for all county, town, city, and village offices on the ballot in that year.   JUSTIFICATION: Because contribution limits are calculated based upon the total number of registered votes in a political subdivision, limits can change from year to year. There is currently no requirement that boards of elections publish such information, although some county boards of elections, including Westchester's, deserve credit for voluntarily doing so. This bill would increase transparency and educate candidates, contributors, as well as voters, fostering compliance with campaign finance rules.   PRIOR LEGISLATIVE HISTORY: 2018: A.9922 - Passed Assembly 140 to 0   FISCAL IMPLICATIONS: None   EFFECTS ON FINES, TERMS OF IMPRISONMENT AND OTHER PENAL SANCTIONS: None   EFFECTIVE DATE: This act shall take effect on the fifteenth day of December after it shall become law.

        AN ACT to amend the  election  law,  in  relation  to  publishing  local
          campaign contribution limits
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 14-114 of the election law is amended by  adding  a
     2  new subdivision 11 to read as follows:
     3    11.  A  board  of  elections,  as defined in subdivision twenty-six of
     4  section 1-104 of this  chapter,  shall  calculate  and  publish  on  its
     5  website,  on  or  before  the  fifteenth  day of April, all contribution
     6  limits established pursuant to this section for the county,  town,  city
     7  and village offices on the ballot in that year, and within the same time
     8  period provide such calculated contribution limits to the state board of
     9  elections in the format required by such board.
    10    §  2.  This  act  shall  take effect on the fifteenth of December next
    11  succeeding the date on which it shall have become a law.
