TITLE OF BILL:
An act to amend the executive law, in relation to increasing the per
student rate of empire state after school program and advantage after
school program grants
 
PURPOSE:
The bill would require the Office of Children and Family Services and
the Division of Budget to align the per student rate of Empire State
After-School Program towards the true costs of programming
 
SUMMARY OF PROVISIONS:
Section one amends the executive law by adding a new section 501-i to
require that Empire State After-School Program grants awarded on or
after August 1, 2025 be provided at a higher per student rate as deter-
mined by the administering agency, Office of Children and Family
Services, and the Department of Budget, provided that the per student
rate is not lower than $4,300.
Section two establishes the effective date.
 
JUSTIFICATION:
Increasing the per-student rate of Empire State After-School Program
(ESAP) to $4,300, even though it is nowhere near the true costs of
programming, is a critical step towards contract and fund alignment with
the Advantage After School Program (AASP), which is the other main state
funding stream that supports afterschool programs in New York State.
True program costs range from just under $3,000 in Buffalo to $6,000 in
NYC.
Per calculations, an increase to $4,300 for the Advantage After School
Program (AASP) and Empire State After-School Program (ESAP) would also
account for the minimum wage increase while holding everything else
constant.
Programs continue to have a difficult time both increasing salaries and
paying for supplies/activities that not only support programs but make
those programs high quality. Most of that amount already went to paying
salaries, before the increase in minimum wage to $12.50 for the state
excluding Long Island, Westchester, and New York City, which has higher
minimum wage rates. With the lack of direct resources and support to
strengthen the afterschool infrastructure, this challenge has exacerbat-
ed greatly amid the pandemic.
As all current rounds of ESAP grants end after the 2021 - 2022 school
year, the Office of Children and Family Services anticipates releasing a
Request for Proposals (RFP) for the next round of applicants in the
fall/winter of 2021. It is critical to update the per student rate for
this funding stream prior to the release,of that RFP

AN ACT to amend the executive law, in relation to increasing the per
student rate of empire state after school program and advantage after
school program grants
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 501-i
2 to read as follows:
3 § 501-i. Empire state after school program and advantage after school
4 program grants. Empire state after school program grants and advantage
5 after school program grants awarded on or after August first, two thou-
6 sand twenty-five shall be provided at a rate of no less than four thou-
7 sand three hundred dollars per approved student. The commissioner of the
8 office of children and family services, in conjunction with the director
9 of the budget, shall, upon the completion of the full term of the empire
10 state after school program and the advantage after school program, modi-
11 fy the amount of money per approved student to be awarded to grant
12 applicants. Such modification shall account for any minimum wage
13 adjustments. The commissioner shall promulgate any rules or regulations
14 necessary to ensure grantees shall serve at least the same number of
15 students in any year that the rate per approved student increases.
16 § 2. This act shall take effect immediately.
