        AN ACT to amend the election law, in relation to voter pre-registration
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.   Paragraph o of subdivision 4  of  section  5-500  of  the
     2  election  law, as amended by chapter 659 of the laws of 1994, is amended
     3  and a new paragraph p is added to read as follows:
     4    o. A space for "remarks" regarding other facts required by this  chap-
     5  ter to be recorded or appropriate to identify the voter[.];
     6    p.  A space for pre-registering applicants to respond to the following
     7  question: "Are you at least 16 years of age and understand that you must
     8  be 18 years of age on or before election day to vote, and that until you
     9  will be eighteen years of age at the time of such election  your  regis-
    10  tration will be marked 'pending' and you will be unable to cast a ballot
    11  in any election?".

     1    § 2. The election law is amended by adding a new section 5-507 to read
     2  as follows:
     3    §  5-507.  Voter pre-registration and education on voter pre-registra-
     4  tion. 1. Pre-registration.  A person who is at least  sixteen  years  of
     5  age  and who is otherwise qualified to register to vote may pre-register
     6  to vote, and shall be automatically registered upon reaching the age  of
     7  eligibility as provided by this chapter.
     8    2.  Encouragement  of student voter registration and pre-registration.
     9  Local boards of education are required  to  adopt  policies  to  promote
    10  student  voter  registration  and  pre-registration.  These policies may
    11  include collaboration with county boards of elections to  conduct  voter
    12  registration  and  pre-registration  in  high  schools.  Completion  and
    13  submission of voter registration or pre-registration forms shall not  be
    14  a course requirement or graded assignment for students.
    15    §  3.  Paragraph (g) of subdivision 5 of section 5-210 of the election
    16  law, as amended by chapter 179 of the laws of 2005, is amended  to  read
    17  as follows:
    18    (g)  Notice that the applicant must be a citizen of the United States,
    19  [is or will be at least eighteen years old not later than December thir-
    20  ty-first of the calendar year in which he or she registers] is at  least
    21  sixteen  years  old when he or she submits an application to register to
    22  vote which will be effective for elections occurring  on  or  after  the
    23  applicant  turns  eighteen  years of age and a resident of the county or
    24  city to which application is made.
    25    § 4. This act shall take effect on the first of January next  succeed-
    26  ing the date on which it shall have become a law. Effective immediately,
    27  the  addition,  amendment and/or repeal of any rule or regulation neces-
    28  sary for the implementation of  this  act  on  its  effective  date  are
    29  authorized to be made and completed on or before such effective date.
