NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A998

SPONSOR: Gantt
TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to increasing the fine for operating a motorcycle with a muffler that produces excessive or unusual noise   PURPOSE: The bill would increase the fine for operating a motorcycle with a muffler that produces excessive or unusual noise from $100 to $700.   SUMMARY OF PROVISIONS: Amends subdivision 13 of section 381 of the vehicle and traffic law, as added by chapter 61 of the laws of 1989 to increase the fine for operat- ing a motorcycle with a muffler that produces excessive or unusual noise from $100 to $700.   JUSTIFICATION: Numerous complaints from the public have been about excessively loud noise from motorcycles. Some motorcyclists modify the exhaust system of a motorcycle in a manner which will amplify or increase the noise emit- ted by the motor. It is currently illegal to modify or remove the muffler system from a motorcycle and continue to operate the motorcycle on public roads. The reputation of motorcycle owners is negatively affected by the extremely load noise from these violators. Unfortunately, the current $100 fine is not providing enough of a deterrent and needs to be increased.   LEGISLATIVE HISTORY: 2009-2010: A.874 2011-2012: A.1292 2013-2014: A.1028 2015-2016: A.597   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect on the first of November next succeeding the date on which it shall have become a law.
