TITLE OF BILL:
An act to amend the education law, in relation to the powers of boards
of education to temporarily lease necessary space
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to allow school districts to lease necessary
space when the facilities of the district are under construction.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 provides school districts the ability to lease necessary
space when the facilities of the district are under construction.
Section 2 sets forth the effective date.
 
JUSTIFICATION:
School districts are already permitted to lease space outside of the
school district when facilities are overcrowded, damaged or destroyed.
This bill would provide school districts with the flexibility of leas-
ing, on a temporary basis, necessary space not located on school proper-
ty, when the existing facilities of the district are under construction.

EFFECTIVE DATE:
The first of July next succeeding the date on which it shall have become

AN ACT to amend the education law, in relation to the powers of boards
of education to temporarily lease necessary space
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 7 of section 1709 of the education law, as
2 added by chapter 130 of the laws of 1976, is amended to read as follows:
3 7. To lease, on a temporary basis, necessary space not located on
4 school property, when the facilities of the district are overcrowded,
5 under construction, or damaged or destroyed, and to furnish and equip
6 such space for school district use. The use of such space shall be
7 subject to annual approval by the commissioner.
8 § 2. This act shall take effect on the first of July next succeeding
9 the date on which it shall have become a law.
