  TITLE OF BILL: An act to amend the executive law, in relation to establishing a toll free confidential hotline for complainants of workplace sexual harass- ment   PURPOSE OR GENERAL IDEA OF BILL: To establish a legal hotline for complainants of workplace sexual harassment.   SUMMARY OF PROVISIONS: Section 1: Amends section 295 of the Executive Law by adding a new subdivision 18 which establishes a confidential legal hotline for work- place sexual harassment complaints which shall be accessible by a toll- free phone number. Experienced attorneys acting in a pro-bono capacity will provide counsel and assistance. Section 2: Sets forth the effective date   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION: Technical amendments were required to change the subdivision number.   JUSTIFICATION: Nearly 75% of all sexual harassment goes unreported and those who do report often face retaliation and inadequate redress. As a result, many victims of workplace sexual harassment are unable to exercise their legal rights because they are not aware of what those rights are and/or are afraid to exercise their rights. This bill will require the Division of Human Rights to establish a toll-free, confidential, and safe legal hotline for reporting workplace sexual harassment. This hotline will be accessible, at minimum, Monday to Friday from 9 a.m. to 5 p.m. The func- tion of the hotline will be to connect complainants with experienced pro-bono attorneys who will help make them aware of their legal rights and advise them on the specifics of their individualized cases. This will help facilitate an easier, more streamlined reporting system.   PRIOR LEGISLATIVE HISTORY: 2019-2020: S4313/A7374 - Died in Finance/Died in Government Operations   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect on the 120th day after it shall become law.
