  TITLE OF BILL: An act to amend the executive law and the general municipal law, in relation to requiring certain police officers to be re-trained in cardiopulmonary resuscitation every two years   PURPOSE: To require all members of the State Police and NYPD police officers be routinely trained in the administration of CPR   SUMMARY OF PROVISIONS: This bill adds a new section 214-e to the executive law and a new subdi- vision b of section 208-h of the General Municipal Law. These new sections require that every police officer, member of the State Police, including police officer trainees and state police cadets, receive CPR training prior to employment as well as during employment every two years where practicable but no later than 4 years and requires that individuals demonstrate proficiency in the technique. A report to legislature is required by May 1St 2018 and every year later detailing number of officers trained and retrained.   JUSTIFICATION: In response to the tragic death of Briana Ojeda in 2010 who died of an asthma attack when the attending police officer was unable to perform CPR, it is imperative that all police officers are adequately trained in the administration of cardiopulmonary resuscitation (CPR. This easy to learn procedure has been proven to save lives in emergency situations and could have helped save the life of Briana Ojeda. This bill will require every police officer in New York State to be retrained and test- ed in CPR. By requiring that all police officers know how to administer CPR we can ensure that those in need will be saved in the future.   LEGISLATIVE HISTORY: S.7886 of 2013/14 S.6717 of 2015/16   FISCAL IMPLICATIONS: Minimal   EFFECTIVE DATE: 60 days after enactment

        AN  ACT  to  amend  the  executive law and the general municipal law, in
          relation to requiring certain police  officers  to  be  re-trained  in
          cardiopulmonary resuscitation every two years
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Short title. This act shall be known and may  be  cited  as
     2  "Briana's law".
     3    §  2.  The  executive  law is amended by adding a new section 214-e to
     4  read as follows:
     5    § 214-e. Cardiopulmonary resuscitation training and  retraining.    1.
     6  For  the purposes of this section, "cardiopulmonary resuscitation" shall
     7  have the same meaning as provided in  subdivision  six  of  section  six
     8  hundred twenty-one of the general business law.
     9    2. Each member of the division of state police shall be:
    10    (a) trained in cardiopulmonary resuscitation during the training proc-
    11  ess to become a trooper;
    12    (b) retrained in cardiopulmonary resuscitation every two years; and
    13    (c) required to demonstrate the satisfactory completion of training in
    14  cardiopulmonary resuscitation.
    15    §  3.  The  general  municipal  law is amended by adding a new section
    16  208-h to read as follows:
    17    § 208-h. Cardiopulmonary resuscitation  training  and  retraining  for
    18  police  departments in cities having a population of one million or more

     1  shall  have  the  same meaning as provided in subdivision six of section
     2  six hundred twenty-one of the general business law.
     3    2.  Every  police  department  in  a  city  having a population of one
     4  million or more shall provide all uniformed personnel of such department
     5  training in cardiopulmonary resuscitation and direct that such  training
     6  be  completed at least every two years to the extent practicable, but no
     7  later than every four years.
     8    § 4. Cardiopulmonary resuscitation report. No later than May  1,  2018
     9  and every May first thereafter, the police department of the city of New
    10  York and the division of state police shall provide to the legislature a
    11  report  which  shall  include  the  total  number  of uniformed officers
    12  assigned to a patrol precinct, transit district, or police service  area
    13  in  the  past  calendar  year,  disaggregated  by:  (a) the total number
    14  trained in cardiopulmonary resuscitation; (b) the total number of  offi-
    15  cers newly trained in cardiopulmonary resuscitation in the past calendar
    16  year;  (c)  the  total  number of officers re-trained in cardiopulmonary
    17  resuscitation in the past calendar year.
    18    § 5. This act shall take effect on the sixtieth  day  after  it  shall
    19  have become a law.
