A02250 Memo:

NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A2250

SPONSOR: Torres
TITLE OF BILL: An act to amend the correction law, in relation to breast cancer screen- ing and diagnostic testing for incarcerated individuals   PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to make amendments to a chapter of the laws of 2024 to effectuate the intent of the bill.   SUMMARY OF PROVISIONS: Section 1 would require breast cancer screenings and diagnostic testing be offered according to nationally recognized clinical practice guide- lines. Section 1 further defines "nationally recognized clinical prac- tice guidelines" as evidence-based clinical practice guidelines devel- oped by professional medical organizations. Section 2 would provide for the effective date.   JUSTIFICATION: In 2008, The Federal Bureau of Prisons (BOP), based on guidelines from the U.S. Preventive Services Task' Force (USPSTF), recommended that all sentenced female inmates receive a Pap smear at intake, all average-risk sentenced women aged 40 and older, and average risk females aged fifty through 74 receive mammograms every 2 years. Breast cancer is the most common cancer among women in New York. It is also the second leading cause of cancer-related death in New York women. Incarcerated individ- uals should be offered the ability to receive this important preventa- tive health care measure on routine basis. Incarcerated individuals should also be educated on the importance of preventative health care measures. The best protection against breast cancer is early detection and diagnosis according to nationally recognized clinical practice guidelines. Eleonora Radovan tragically passed away from breast cancer in 1999 at the age of 70, and she was passionate about social justice and breast cancer prevention. Working in conjunction with First Company Pink, a local charity focused on breast health, and its corresponding 'Got Checked?' campaign, this vital legislation will continue Eleonora's legacy of social justice and prevention. By expanding these vital services to incarcerated individuals, Eleonora's legacy will be one of saving lives. Chapter 570 of the laws of 2024 required incarcerated individuals to be provided routine mammograms every two years. This chapter amendment would expand the requirement to include breast cancer screenings to be done accordance with nationally recognized clinical practice guidelines as they are recommended by a physician. This amendment will allow physi- cians to make recommendations based on incarcerated individual's specif- ic health needs.   PRIOR LEGISLATIVE HISTORY: New Bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2024 amending the correction law relating to providing incarcerated individuals with access to breast cancer screen- ings and information about breast self-examinations, as proposed in legislative bills numbers S. 204 and A. 4957, takes effect.
