  TITLE OF BILL: An act to amend the criminal procedure law, in relation to providing access to live scan fingerprinting to society for the prevention of cruelty to animals officers   PURPOSE: To amend the criminal procedure law, in relation to providing society for the prevention of cruelty to animals officers access to live scan fingerprinting.   SUMMARY OF SPECIFIC PROVISIONS: Section one adds subdivision 1-a which states that following an arrest by a society for the prevention of cruelty to animal officer, such offi- cer shall be permitted access to the live scan fingerprinting system or similar technology. Section two states effective date.   JUSTIFICATION: The society for the prevention of cruelty to animals officers main role is to defend and protect animals, often times this includes conducting arrests. As the procedure currently stands the arresting officer hands off the suspect in question to the assisting agency so they can complete the arrest. Unfortunately, this procedure leaves room for error and can make the process time consuming. Giving the society for the prevention of cruelty to animals officers access to live scan fingerprinting tech- nology allows said officers to complete arrests independently and with- out the assistance of other law enforcement personnel saving valuable time and resources.   LEGISLATIVE HISTORY: 2023-24:A.1196- Referred to Codes; S.1182 - Passed Senate 2021-22:A.3445- Referred to Codes; S.2978 - Referred to Codes 2019-20:A.9637- Referred to Codes; S.7059 - Referred to Codes   FISCAL IMPLICATIONS: None to the State.   EFFECTIVE DATE: This act shall take effect on the one hundred eightieth day after it becomes a law.         AN  ACT  to  amend  the criminal procedure law, in relation to providing
          access to live scan fingerprinting to society for  the  prevention  of
          cruelty to animals officers

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 160.10 of the criminal procedure law is amended  by
     2  adding a new subdivision 1-a to read as follows:
     3    1-a. Following an arrest by a society for the prevention of cruelty to
     4  animals officer, such officer shall be permitted access to the live scan
     5  fingerprinting  system  or similar technology in order to effectuate the
     6  completion of such arrest independently and without  the  assistance  of
     7  other law enforcement personnel.
     8    § 2. This act shall take effect on the one hundred eightieth day after
     9  it  shall have become a law. Effective immediately, the addition, amend-
    10  ment and/or repeal of any rule or regulation necessary for the implemen-
    11  tation of this act on its effective date are authorized to be  made  and
    12  completed on or before such effective date.
