TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to creating the
New York state veterans remembrance license plate
 
PURPOSE::
This bill creates the New York State Veterans Remembrance License Plate.
 
SUMMARY OF PROVISIONS::
Section 1: Any veteran or spouse of a veteran, who resides in this State
shall upon request, be issued a license plate bearing the words "NYS
Veterans Remembrance." Application for the license plate shall be filed
with the Commissioner of Motor Vehicles in such form and detail as the
Commissioner shall prescribe. The distinctive plate shall be issued upon
proof, satisfactory to the Commissioner of Motor Vehicles. An additional
annual service charge of twenty-five dollars shall be charged for the
distinctive plate. The annual charge shall be deposited to the distinc-
tive plate development fund and shall be used for the production,
design, advertising and marketing of the "NYS Veterans Remembrance"
distinctive license plates. Annual service charges collected in excess
of six thousand dollars shall be deposited to the Veterans' remembrance
and cemetery maintenance operation fund.
Section 2: Sets out the requirements for the license plate to be
created.
Section 3: Sets the effective date.
 
JUSTIFICATION::
We have no greater obligation than to honor and thank our veterans for
the countless sacrifices they have made to protect our freedom and
defend our Nation. Those who have borne the cost for our freedom deserve
a place of dignity as their final resting place. This legislation
creates the opportunity to honor those veterans who have given so much
for our freedom by supporting the New York State Veterans Remembrance
and Cemetery Maintenance Operation Fund, which is a critical first step
to establishing a New York State Veterans' Cemetery.
This legislation establishes an additional revenue sources for the
veterans remembrance and cemetery maintenance operation fund by using
the revenue generated by the "NYS Veterans Remembrance" license plates.
This fund is an important first step in the process to designate specif-
ic areas in New York State for a State Veterans cemetery.
Just as our veterans recognized their duty to honor and serve their
Nation, we too must recognize our duty as Americans to honor the
profound sacrifices they made so that we can live our lives in freedom.
These distinctive plates will help serve as an important reminder of
their important sacrifice.

AN ACT to amend the vehicle and traffic law, in relation to creating the
New York state veterans remembrance license plate
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 404-ff to read as follows:
3 § 404-ff. Distinctive plates for the New York state veterans remem-
4 brance. 1. Any veteran or the spouse of any such veteran shall, upon
5 request, be issued a license plate bearing the words "NYS Veterans
6 Remembrance". If a distinctive plate is issued to a veteran pursuant to
7 this section, such a distinctive plate shall not be issued to the spouse
8 of such veteran. Application for such license plate shall be filed with
9 the commissioner in such form and detail as the commissioner shall
10 prescribe.
11 2. The distinctive plate authorized in subdivision one of this section
12 shall be issued upon proof, satisfactory to the commissioner, that the
13 applicant or the spouse of the applicant is a veteran.
14 3. A distinctive plate issued pursuant to this section shall be issued
15 in the same manner as other number plates upon the payment of the regu-
16 lar registration fee prescribed by section four hundred one of this
17 article; provided, however, that an additional annual service charge of
18 twenty-five dollars shall be charged for such plates. Such annual
19 service charge shall be deposited pursuant to the provisions of section
20 four hundred four-oo of this article, to the credit of the department of
21 motor vehicles distinctive plate development fund established by section
22 ninety-five-g of the state finance law, and shall be used for the
23 production, design, advertising and marketing of distinctive license
24 plates pursuant to such section ninety-five-g; provided, however, that
25 annual service charges collected in excess of six thousand dollars shall

1 be deposited to the credit of the veterans remembrance and cemetery
2 maintenance operation fund and shall be used for furtherance of the
3 maintenance and operation of state veterans cemeteries, pursuant to
4 section ninety-seven-mmmm of the state finance law.
5 § 2. 1. A distinctive plate established pursuant to section 404-ff of
6 the vehicle and traffic law as added by section one of this act shall
7 only be designed, produced and issued upon the delivery to the depart-
8 ment of motor vehicles of a surety bond in the amount of six thousand
9 dollars, which shall be executed by a surety company authorized by the
10 department of financial services to transact business in this state.
11 Provided, however, that if the commissioner of motor vehicles shall have
12 received prior to plate design, production and issuance at least two
13 hundred orders for such distinctive plate together with the additional
14 annual service charge applicable to each such order, which shall be
15 non-refundable, no such surety bond shall be required. All such service
16 charges shall be deposited pursuant to the provisions of section 404-oo
17 of the vehicle and traffic law to the credit of the department of motor
18 vehicles distinctive plate development fund established by section 95-g
19 of the state finance law and shall be used for the design, production,
20 advertising and distribution of distinctive license plates in accordance
21 with such section 95-g.
22 2. If, upon the expiration of two years following the date upon which
23 distinctive plates in the series are first available for sale two
24 hundred or more sets of such plates are sold, a bond delivered pursuant
25 to this section shall be discontinued. If fewer than two hundred sets of
26 such plates are sold by such time, such department shall be entitled to
27 recover against the bond in an amount proportionate to such shortfall.
28 § 3. This act shall take effect immediately; provided, however, that
29 section one of this act shall take effect on the one hundred eightieth
30 day after it shall have become a law. Effective immediately, the addi-
31 tion, amendment and/or repeal of any rule or regulation necessary for
32 the implementation of this act on its effective date are authorized to
33 be made and completed on or before such effective date.
