TITLE OF BILL:
An act to amend the election law, in relation to making technical
corrections thereto
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill amends subdivision 6 of section 9-211 of the election law to
make a conforming change in the process for canvassing absentee, mili-
tary, special and affidavit ballots in order to obtain the results of an
election in a more expedited manner and to assure that every valid vote
by a qualified voter is counted.
 
SUMMARY OF PROVISIONS:
This is a technical change to 2021-2022 bill S1027A.

AN ACT to amend the election law, in relation to making technical
corrections thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 6 of section 9-211 of the election law, as
2 amended by chapter 763 of the laws of 2021, is amended to read as
3 follows:
4 6. Notwithstanding subdivision [four] five of this section, if a
5 voting machine or system is found to have failed to record votes in a
6 manner indicating an operational failure, the board of canvassers shall
7 use the voter verifiable audit records to determine the votes cast on
8 such machine or system, provided such records were not also impaired by
9 the operational failure of the voting machine or system.
10 § 2. This act shall take effect immediately.
