NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)
BILL NUMBER: A5964
TITLE OF BILL:
An act to amend the agriculture and markets law, in relation to the sale
of ice cream or other frozen deserts made with wine
To allow for the sale of wine ice cream in packages that are less than
SUMMARY OF PROVISIONS:
Section 1 repeals the minimum packaging requirements for the sale of
wine ice cream
Section 2 is the effective date.
Currently, New York allows for the sale of wine ice cream in packages
that are one pint in volume or greater, but not less.
The sale of wine ice cream was enacted into law in 2008. Since that
time, the demand for smaller packaging for weddings, fundraisers, recre-
ational tours and other events has increased. This bill would lift the
minimum requirements that are currently in law so as to accommodate this
demand for smaller packaging sizes.
