NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6194

SPONSOR: Norris
TITLE OF BILL: An act to amend the election law, in relation to removal of deceased voters and certain persons subject to forfeiture of the right to vote from the statewide voter registration list   PURPOSE OR GENERAL IDEA OF BILL: Establishes the timeframe in which State Board of Elections must obtain and transmit the list of persons who have died or are subject to forfei- ture of the right to vote bi-monthly and lowers the days in which local boards of elections must remove such persons from the voter roll.   SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends subdivisions 5 and 6 of Section 5-614 of the Election Law to require the State Board of Elections to obtain and transmit the list of persons who have died or are subject to forfeiture of the right to vote bi-monthly and lower the number of days a local board of election must identify and remove such decedents and persons subject to forfeiture of the right to vote from twenty-five to fourteen. Section 2: Establishes the effective date.   JUSTIFICATION: Currently Election Law does not provide an affirmative time in which the State Board of Elections must obtain and transmit the list of ineligible voters due to death or forfeiture of the right to vote. Additionally, the Law fails to provide that the State Board of Elections must do so continually throughout the year. It is important to maintain and update registration lists as a voter dies or becomes ineligible. Providing specific and narrow timeframes for removing ineligible voters ensures trust in our electoral system and will help remove suspicion of fraudu- lent acts.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: Immediately.
