TITLE OF BILL:
An act to amend the state law, in relation to establishing assembly
districts; and to repeal title I of article 8 of such law relating ther-
eto
 
PURPOSE:
The purpose of this bill is to establish 150 Assembly districts in New
York State in accordance with a court order. (Paul Nichols et al v.
Governor Kathy Hochul et al.)
 
SUMMARY OF PROVISIONS:
This bill repeals the existing Article 8 of State Law and adds a new
Article 8 establishing new boundaries for New York. State's 150 Assembly
districts. Vacancies in the office of Assembly shall be filled using
the boundaries existing prior to this bill's enactment through January
1, 2025, at which time vacancies shall be filled using the new bounda-
ries established by this act.
 
JUSTIFICATION:
On September 29, 2022, The Honorable Justice Laurence L. Love of the New
York State Supreme Court of New York-County ordered that the New York
State Independent Redistricting Commission 'shall prepare' the redis-
tricting plan to establish assembly districts and shall submit to the
legislature such plan and the implementing legislation therefor on or
before April 28, 2023.
This bill establishes new legislative districts for the State Assembly.
The districts are based on population figures. from the 2020 Federal
Census, in accordance with present law regarding prisoner allocation.
All districts comply with the United States and New York State Consti-
tutions as well as the requirements of the Federal Voting' Rights Act.

EFFECTIVE DATE:
This act shall take effect immediately, provided that the provisions of
section four of this act shall take effect on January 1, 2025.
