MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A6822 SPONSOR: Stirpe
  TITLE OF BILL: An act to amend the environmental conservation law, in relation to big game hunting authorization for the county of Onondaga; and providing for the repeal of such provisions upon expiration thereof   PURPOSE OF BILL: The purpose of this bill is to allow, hunting of big game with a rifle in Onondaga County.   SUMMARY OF PROVISIONS: Section 1: Amends paragraph A of subdivision 2 of section 11-0907 of the Environmental Conservation Law by adding a new item (o) to allow rifle hunting of big game in Onondaga County from the first Saturday after November 15 through the first Sunday after December 7. Section 2: Amends item (f) of paragraph A of subdivision 2 of section 11-0907 of the Environmental Conservation Law to include a new item (o) to allow rifle hunting of big game in Onondaga County from the first Monday after November 15 through the first Tuesday after December 7. Section 3: Amends paragraph A of subdivision 2 of section 11-0907 of the Environmental Conservation Law by adding a new item (m) to allow rifle hunting of big game in Onondaga County, from the first Saturday after November 15 through the first Sunday after December 7. Section 4: Amends item (f) of paragraph A of subdivision 2 of section 11-0907 of the Environmental Conservation Law to include a new item (m) to allow rifle hunting of big game in Onondaga County from the first Monday after November 15 through the first Tuesday after December 7. Section 5: Provides the effective date.   JUSTIFICATION: Over 700,000 New York State residents hunt for big game in the State each year. Hunting is a crucial conservation tool that keeps deer and bear populations in check. Due to a variety of factors, the State's deer population has rapidly increased to over 1.2 million. The overabundance of deer negatively impacts farmers, homeowners, foresters, and drivers. According to the Department of Environmental Conservation, hunters take around 220,000 deer annually, thereby reducing the problems that accom- pany deer overabundance. Hunters across most of the State are permitted to use rifles to hunt big game except in two Upstate counties - Onondaga and Livingston. Since 2005, several counties in the Finger Lakes Region, Central New York, and the Southern Tier have permitted hunting big game with rifles with very few reported incidents or problems. Most recently, in 2020, Tompkins County was authorized to allow licensed hunters to use rifles for hunt- ing big game. Since then, there have been no serious incidents reported in that county as a result of that authorization. Therefore, this bill should be passed to authorize big game hunting with rifles in Onondaga County.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.

Paragraph a of subdivision 2 of section 11-0907 of the 2 environmental conservation law is amended by adding a new item (p) to 3 read as follows: 4 (p) The county of Deer, the first Pistol, shotgun, 5 Onondaga Saturday after November crossbow, muzzle 6 15 through first Sunday loading firearm, 7 after December 7 rifle or long bow 8 § 2. Item (f) of paragraph a of subdivision 2 of section 11-0907 of 9 the environmental conservation law, as amended by section 2 of chapter 10 152 of the laws of 2020, is amended to read as follows: 11 (f) Southern tier, Deer, first Pistol, shotgun, 12 central and Western Monday after November crossbow, 13 region, except those 15 through first muzzle loading 14 counties or portions Tuesday after firearm or 15 thereof listed in December 7 long bow only 16 item (i), (j), (k), 17 (l), (m), (n) [or], 18 (o) or (p) 19 of this paragraph 20 § 3. Paragraph a of subdivision 2 of section 11-0907 of the environ- 21 mental conservation law is amended by adding a new item (n) to read as 22 follows: 23 (n) The county of Deer and bear, the Pistol, shotgun, 24 Onondaga first Saturday after crossbow, muzzle EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Item (f) of paragraph a of subdivision 2 of section 11-0907 of 5 the environmental conservation law, as amended by section 4 of chapter 6 152 of the laws of 2020, is amended to read as follows: 7 (f) Southern tier, Deer and bear, first Pistol, shotgun, 8 central and Western Monday after November crossbow, muzzle 9 region, except those 15 through first loading firearm 10 counties or portions Tuesday after or long bow only 11 thereof listed in December 7 12 item (i), (j), (j), 13 (k), (l) [or], 14 (m) or (n) 15 of this paragraph 16 § 5. This act shall take effect immediately; provided, however, that: 17 a. the amendments to paragraph a of subdivision 2 of section 11-0907 18 of the environmental conservation law made by section one of this act 19 shall be subject to the expiration and reversion of such paragraph 20 pursuant to section 13 of chapter 600 of the laws of 1993, as amended; 21 b. the amendments to item (f) of paragraph a of subdivision 2 of 22 section 11-0907 of the environmental conservation law made by section 23 two of this act shall be subject to the expiration and reversion of such 24 item pursuant to paragraph d of section 5 of chapter 152 of the laws of 25 2020, as amended by section five of this act; 26 c. sections three and four of this act shall take effect upon the 27 expiration and reversion of paragraph a of subdivision 2 of section 28 11-0907 of the environmental conservation law, as provided in section 13 29 of chapter 600 of the laws of 1993, as amended; and 30 d. nothing contained in this act shall be construed so as to extend 31 the provisions of this act beyond October 1, 2025, when upon such date 32 this act shall expire and the provisions contained herein shall be 33 deemed repealed.
