MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the public health law, in relation to including informa- tion on congenital heart defect births in the informational leaflets required to be given to maternity patients   PURPOSE: This bill would require hospitals and birth centers to include informa- tion on Congenital Heart Defects for maternity patients and their fami- lies.   SUMMARY OF PROVISIONS: 2803-i of the public health law, as amended by chapter 62 of the laws of 1996. is amended by adding a new subdivision 1-e to read as follows: The informational leaflet shall also include information related to congen- ital heart defect births. including treatment requirements. and any other information shall deem appropriate.   JUSTIFICATION: Congenital Heart Defects ICHOs) are the most common type of birth defect. CHDs are present at birth and can affect the structure of a baby's heart and the way it works. They can affect how blood flows through the heart and out to the rest of the body. CHDs can vary from mild (such as a small hole in the heart) to severe (such as missing or poorly formed parts of the heart). About 1 in 4 babies born with a heart defect has a critical CHD . Babies with a critical CHD need surgery or other Procedures in the first year of life. The burden of pregnancy represents a new challenge in women with congenital heart disease. Hospitals and birth centers should therefore be aware of the risks that women with congenital heart disease face during pregnancy by providing as much information as possible so that maternity patients can be given adequate preconception counseling and optimal care during pregnancy, delivery, and the postpartum period. According to section 2803-i of the Public Health Law, hospitals and birth centers are required to Provide an informational leaflet to mater- nity patients including information on maternity related procedures and practices. This proposed legislation would require hospitals and birth centers to include information on Congenital Heart Defects for maternity patients and their families. This information will include the types of Congenital Heart Defects, signs and symptoms, diagnosis, causes and treatment.   LEGISLATIVE HISTORY: This is a new bill.   BUDGET IMPLICATIONS: None noted.   EFFECTIVE DATE: This act shall take effect immediately

        AN ACT to amend the public health law, in relation to including informa-
          tion on congenital heart defect births in the  informational  leaflets
          required to be given to maternity patients
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Short title. This act shall be known and may  be  cited  as
     2  "Paul's law".
     3    § 2. Section 2803-j of the public health law, as amended by chapter 62
     4  of  the laws of 1996, is amended by adding a new subdivision 1-e to read
     5  as follows:
     6    1-e. The informational leaflet shall also include information  related
     7  to  congenital heart defect births, including treatment recommendations,
     8  and any other information the commissioner shall deem appropriate.
     9    § 3. This act shall take effect on the thirtieth day  after  it  shall
    10  have become a law. Effective immediately, the addition, amendment and/or
    11  repeal  of  any  rule  or regulation necessary for the implementation of
    12  this act on its effective date are authorized to be made  and  completed
    13  on or before such effective date.
