  TITLE OF BILL: An act to amend the executive law, in relation to fire-resistant materi- al applicator training   PURPOSE OR GENERAL IDEA OF BILL: The bill mandates training and certification for fire-resistant material applicators and imposes fines for violations.   SUMMARY OF PROVISIONS: Section 1. § 155-a of the executive law is amended by adding two new subdivisions 6 and 7 to define fire-resistant material and fire-resis- tant material applicator. Section 2. The executive law is amended by adding a new § 159-b to require that fire-resistant material applicators undergo training to apply fire-resistant material according to manufacturer specifications and sets fines for violations of these requirements. Section 3. Effective date.   JUSTIFICATION: Building fires can escalate rapidly, reaching extreme temperatures of 1,000 degrees Fahrenheit in mere minutes. This underscores the critical importance of effective fireproofing measures to safeguard structural steel and prevent catastrophic collapses and fire-related fatalities. Requiring fire-resistant material applicators to undergo a training program will ensure these essential materials are applied correctly and consistently by trained professionals, providing a vital layer of protection for buildings.   PRIOR LEGISLATIVE HISTORY: 2023-2024: 6814A, reported to rules.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This law shall take effect immediately after it shall become a law.

        AN ACT to amend the executive law, in relation to fire-resistant materi-
          al applicator training
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 155-a of the executive law is amended by adding two
     2  new subdivisions 6 and 7 to read as follows:
     3    6.  "Fire-resistant material" shall mean cementitious or fibrous mate-
     4  rials  that  are  sprayed  onto  a  surface  to  provide  fire-resistant
     5  protection of the substrate.
     6    7.  "Fire-resistant  material applicator" shall mean an individual who
     7  applies fire-resistant material.
     8    § 2. The executive law is amended by adding a  new  section  159-b  to
     9  read as follows:
    10    §  159-b.  Fire-resistant material applicators training. 1.  The state
    11  fire administrator shall develop and  conduct  a  training  program  for
    12  fire-resistant  material applicators. The state fire administrator shall
    13  promulgate rules and regulations including, but not limited to:
    14    (a) Minimum courses of study, informed by manufacturer specifications,
    15  and attendance and registration requirements for such training  program;
    16  and
    17    (b)  Requirements  to  be  eligible  and  receive a certification upon
    18  completion of such training program.
    19    2. Every fire-resistant material applicator shall complete such train-
    20  ing and obtain a certification.
    21    3. Any person applying fire-resistant material who  does  not  receive
    22  the  training  and obtain a certification as required by subdivision two
    23  of this section shall be fined not more than two hundred  fifty  dollars
    24  for each violation.
    25    § 3. This act shall take effect immediately.
