  TITLE OF BILL: An act to amend the multiple residence law and the multiple dwelling law, in relation to requiring owners and agents of multiple residences and multiple dwellings to provide names and contact information of resi- dents to emergency personnel   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to make amendments to Chapter 635 of the Laws of 2023.   SUMMARY OF PROVISIONS: Section one of the bill amends the multiple residence law to provide public housing authorities, including those established after January 1, 1939, can update the list of names and contact information for residents upon annual recertification. Section two amends the multiple dwelling law to provide public housing authorities, including those established after January 1, 1939, can update the list of names and contact information for residents upon annual recertification. Section three of the bill relates to the effective date.   JUSTIFICATION: On August 11, 2019, a fire in a Yonkers Apartment building displaced eighty-six people displaced from their homes. The fire caused excessive damage to the five-story building and took 60 firefighters. Luckily, no one was injured by the fire but during the blaze emergency responders were unable to determine who was safely out of the building. When emer- gency personnel contacted the building ownership to determine if every- one was safely evacuated, it was difficult to get a list of who was living in the building and their contact. In the case of an emergency, first responders are best equipped to do their job and prevent the loss of life when they are fully informed. When triaging an emergency preventing the loss of life or injury is critical but when the information required to do so is withheld this task in even more difficult. This bill seeks to help preserve the life and health of residents of multiple dwelling/residence building by enabling emergency personnel to have access to the information they need.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2023 amending the multiple residence law and the multiple dwelling law relating to requiring owners and agents of multi- ple residences and multiple dwellings to provide names and contact information of residents to emergency personnel, as proposed in legisla- tive bills numbers S.2294-A and A.2134-A, takes effect.

        AN  ACT  to  amend  the multiple residence law and the multiple dwelling
          law, in relation to requiring owners and agents of multiple residences

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 2 of section 16 of the multiple residence  law,
     2  as  added  by  a chapter of the laws of 2023 amending the multiple resi-
     3  dence law and the multiple dwelling law relating to requiring owners and
     4  agents of multiple residences and multiple dwellings  to  provide  names
     5  and contact information of residents to emergency personnel, as proposed
     6  in  legislative  bills numbers S.2294-A and A.2134-A, is amended to read
     7  as follows:
     8    2. The owner or agent of such multiple residence shall update the list
     9  of names and contact information of all affected residents or  occupants
    10  of  such  multiple  residence  upon  the execution of a new lease, lease
    11  renewal or lease amendment, or where such owner is an authority as  such
    12  term  is  defined  in section three of the public housing law, including
    13  all such authorities established after the first day of  January,  nine-
    14  teen  hundred  thirty-nine,  upon  annual  recertification. Specific and
    15  informed written consent shall be obtained by the owner or agent of  the
    16  multiple  residence from each occupant or resident each time the list is
    17  updated and no occupant's or  resident's  name  or  contact  information
    18  shall be included in such list without their specific and informed writ-
    19  ten  consent.  Written notice shall be provided to the occupant or resi-
    20  dent about the contact list and shall include but not be limited to that
    21  such list is maintained  by  the  owner  and  the  potential  impact  of
    22  opting-out.
