KASSAY -- (at request of the Environmental Facil- ities Corporation) -- read once and referred to the Committee on Envi- ronmental Conservation AN ACT to amend the public authorities law, in relation to the septic system replacement fund The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraphs (c), (d), (e) and (f) of subdivision 1 of 2 section 1285-u of the public authorities law, are relettered paragraphs 3 (d), (e), (f) and (g) and a new paragraph (c) is added to read as 4 follows: 5 (c) "Enhanced septic system project" means an onsite decentralized 6 wastewater treatment system(s) that (i) at a minimum, is designed to 7 reduce total nitrogen in treated effluent to 19 mg/l or (ii) signif- 8 icantly and quantifiably reduces environmental and/or public health 9 impacts associated with phosphorous or per- and polyfluoroalkyl 10 substances and associated compounds in effluent from a cesspool or 11 septic system. 12 § 2. Paragraph (a) of subdivision 2 of section 1285-u of the public 13 authorities law, as amended by chapter 363 of the laws of 2017, is 14 amended to read as follows: 15 (a) There is hereby created the state septic system replacement fund, 16 which shall be administered by the corporation to reimburse property 17 owners or at the written request of a property owner, the septic system 18 installer contracted by the property owner, for up to (i) fifty percent 19 of the eligible costs incurred for eligible septic system projects, 20 provided that no property owner shall be reimbursed more than ten thou- 21 sand dollars and no septic system installer may be reimbursed more than 22 ten thousand dollars per property for such projects; or (ii) seventy- 23 five percent of the eligible costs incurred for enhanced septic system 24 projects, provided that no property owner shall be reimbursed more than EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10327-05-5A. 8807 2 1 twenty-five thousand dollars and no enhanced septic system installer may 2 be reimbursed more than twenty-five thousand dollars per property for 3 such projects. 4 § 3. This act shall take effect immediately and shall apply to all 5 enhanced septic system projects for which a property owner has signed a 6 participation agreement with a participating county on or after such 7 date.
