NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A9181B

SPONSOR: Burgos
TITLE OF BILL: An act to amend the general business law, in relation to the sale of electric space heaters   PURPOSE OR GENERAL IDEA OF BILL: To ensure that electric space heaters sold in New York State conform to the highest possible fire safety standards.   SUMMARY OF PROVISIONS: The GBL is amended to provide that no electric space heaters may be sold in New York State by a person, firm, partnership association or corpo- ration regularly engaged in the business of assembling, manufacturing, distributing, or retail sale of space heaters unless they: contain a thermostat; have an automatic shutoff; and have been certified by an approved body.   DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE): This version clarifies that "electric" space heaters are intended to be captured by this legislation.   JUSTIFICATION: The use of space heaters, in residential and other settings, during cold months is widespread. Sadly, space heaters do have a propensity of caus- ing fires, thus we must ensure that those sold in New York State conform to the highest possible standards of safety and fire prevention.   PRIOR LEGISLATIVE HISTORY: New Proposal.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None of consequence noted.   EFFECTIVE DATE: This act shall take effect on the one hundred and twentieth day after it shall have become a law.
