MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the agriculture and markets law, in relation to indus- trial hemp development   PURPOSE: The purpose of this legislation is to encourage the use of industrial hemp grown in New York by businesses.   SUMMARY OF SPECIFIC PROVISIONS: The bill would amend section 519 of the Agriculture and Markets Law to update the hemp economic development section of law to clarify that the Commissioner shall work with the urban development corporation, the New York State hemp workgroup created in Cannabis Law, and representatives of industries that currently use, or may potentially use, industrial hemp in their products, to develop and promote the use of hemp by busi- nesses for purposes such as packaging, construction, and other uses.   JUSTIFICATION: New York is a leader in the cultivation and processing of hemp, espe- cially for cannabinoid hemp. The market for New York industrial hemp is still developing and the state needs to take an active role in research- ing, identifying, and promoting hemp to industries that may incorporate it into their products. For example, as the market for sustainable, biodegradable, non-petroleum-based packaging grows, so do the opportu- nities for New York produced industrial hemp as an ingredient in these products. This legislation will encourage renewed focus by the State to work with growers, processors and businesses that are end users to expand market opportunities.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: Undetermined.   EFFECTIVE DATE: This act shall take effect immediately.

          tee on Agriculture
 
        AN ACT to amend the agriculture and markets law, in relation  to  indus-
          trial hemp development
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 519 of the agriculture and markets law, as added by
     2  chapter 1 of the laws of 2020, is amended to read as follows:
     3    § 519. Hemp economic development.  [To  the  extent  the  commissioner
     4  believes  it  to  be  necessary, the] The commissioner shall consult and
     5  cooperate with the New York state urban development corporation, the New
     6  York state hemp workgroup created pursuant to section one hundred  eight
     7  of  the  cannabis  law, and representatives of industries that currently
     8  use, or may potentially use, industrial hemp  in  their  products,  with
     9  respect to the funding and support of research, and product and business
    10  development  and  promotion,  concerning hemp and businesses involved in
    11  growing, cultivating, and processing hemp for uses  including,  but  not
    12  limited to food, fiber, packaging, cannabinoid content, and construction
    13  materials [and other uses].
    14    § 2. This act shall take effect immediately.
