TITLE OF BILL: An act making an appropriation for payment of state
aid to municipalities
 
PURPOSE OR GENERAL IDEA OF BILL: This bill would appropriate
$70,000,000 to the Office of Children and Family Services for the
purpose of making reimbursement payment to local social services
districts for child protective services expenditures.
 
SUMMARY OF SPECIFIC PROVISIONS:; This bill contains a single item of
appropriation of $70,000,000 for child protective services reimbursement
to local social services districts.
 
JUSTIFICATION:; This legislation is necessary to ensure that local
social services districts are reimbursed for child protective services
expenditures incurred on or after October 1, 2000. These services were
reimbursed outside of the Family and Children's Services Block Grant in
State Fiscal Year 2000-01, and this bill would allow the direct
reimbursement mechanism to continue. This legislation would appropriate
$70,000,000 to the Office of Children and Family Services from the
general fund / aid to localities, local assistance account - 001.
 
PRIOR LEGISLATIVE HISTORY: New bill.
 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: An appropriation
of $70,000,000 would be authorized in the Office of Children and Family
Services upon enactment of this legislation.
 
EFFECTIVE DATE: Effective immediately and retroactive to April 1,
2001.

AN ACT making an appropriation for payment of state aid to munici-
palities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The sum of seventy million dollars ($70,000,000), or so
2 much thereof as may be necessary, is hereby appropriated to the office
3 of children and family services from the general fund / aid to locali-
4 ties, local assistance account - 001, not otherwise appropriated, for
5 payment of state aid heretofore accrued or hereafter to accrue to muni-
6 cipalities. Subject to the approval of the director of the budget, the
7 money hereby appropriated shall be available to the office net of disal-
8 lowances, refunds, reimbursements, and credits. Notwithstanding any
9 inconsistent provision of law, in lieu of payments authorized by the
10 social services law, or payments of federal funds otherwise due to the
11 local social services districts for programs provided under the federal
12 social security act or the federal food stamp act, funds herein appro-
13 priated, in amounts certified by the state commissioner or the state
14 commissioner of health as due from local social services districts each
15 month as their share of payments made pursuant to section 367-b of the
16 social services law may be set aside by the state comptroller in an
17 interest-bearing account with such interest accruing to the credit of
18 the locality in order to ensure the orderly and prompt payment of
19 providers under section 367-b of the social services law pursuant to an
20 estimate provided by the commissioner of health of each local social
21 services district's share of payments made pursuant to section 367-b of
22 the social services law. Notwithstanding any inconsistent provision of

1 law, the amount appropriated herein shall be available for reimbursement
2 of 65 percent of social services districts child protective services
3 expenditures incurred on or after October 1, 2000, after first deducting
4 therefrom any federal funds properly received or to be received on
5 account thereof.
6 Such moneys shall be payable on the audit and warrant of the state
7 comptroller on vouchers certified or approved in the manner provided by
8 law.
9 § 2. This act shall take effect immediately and shall be deemed to
10 have been in full force and effect on and after April 1, 2001.
