MEMORANDUM IN SUPPORT OF LEGISLATION

BILL NUMBER: A10157

  TITLE OF BILL: An act to repeal subdivision 6 of section 51 of the public authorities law, relating to voting by members of the New York state authorities control board   PURPOSE OR GENERAL IDEA OF BILL: To repeal subdivision 6 of section 51 of the Public Authorities Law, relating to voting by members of the New York state authorities control board.   SUMMARY OF PROVISIONS: Section one repeals subdivision 6 of section 51 of the Public Authori- ties Law, relating to voting by members of the New York state authori- ties control board. Section two provides the effective date.   JUSTIFICATION: Subdivision 6 of Section 51 of the Public Authorities Law was included as part of the FY 2019-20 New York State Budget. However, this subdivi- sion is redundant and unnecessary and should be repealed. Subdivision 3 of Section 51 already states that the board may approve projects if "there are commitments of funds sufficient to finance the acquisition and construction of such project." Furthermore, legislators are already subject to the provisions of the Public Officers Law and the reference to Public Officers Law 74(3)(h) is unwarranted. Finally, subdivision 6 addresses board appointments, however section 50 of the Public Authorities Law already fully sets forth the appointment process.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: Immediate .

        AN  ACT  to repeal subdivision 6 of section 51 of the public authorities
          law, relating to voting by members of the New York  state  authorities
          control board

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 6 of section 51 of the public  authorities  law
     2  is REPEALED.
     3    § 2. This act shall take effect immediately.
