NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A10492

SPONSOR: Rules (Reyes)
TITLE OF BILL: An act to amend the labor law, in relation to employer violations of certain provisions allowing for workplace safety committees   PURPOSE: To ensure enforcement of Labor Law section 27-d by the Department of Labor.   SUMMARY OF PROVISIONS: Section 1 amends section 27-d of the labor law by adding a new subdivi- sion 9. Requires employers to recognize within five business days the establish- ment of a workplace safety committee created pursuant to section 27-d of this chapter. Violations shall result in a civil penalty of not less than fifty dollars per day until the violation is remedied. Provides that the commissioner may also appropriate relief including enjoining the conduct of any person or employer in addition to any other remedies permitted by this section. Section two sets the effective date.   JUSTIFICATION: This bill would require employers to recognize the establishment of workplace safety committees and provide for a civil penalty as an enforcement mechanism. This will ensure that employers are held account- able for violations of Section 27-d of the Labor Law, as established by the NY HERO Act. The workplace safety committees will provide crucial insight into workplace health and safety policies and recommendations.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
